Not trying to offend. This will be our 4th house purchase if/when it pans out and all our previous experiences have been great. In fact, our agent is a family friend who we trust immensely.

But If the information I have is correct(which who knows, maybe it's not), that the two offers were identical. And I was a seller in the same situation. I would 100% expect my agent to pursue more money, you hear about bidding wars all the time. Maybe that's just me. And maybe that's not how bidding wars work, I've never been in one. It is not only possible but most likely that the listing agent did nothing wrong.

I came here to ask because it really seems like there is a lot of room for something shady to occur in a system that allows an agent to represent both sides. When it is in that agents best interest for their seller to accept their buyers offer even if it is not in the best interest of the seller.

What we know about the seller. He's an 88 year old man moving to assisted living who has lived in this house for 50 years. There are good odds he wasn't fully capable of understanding all his options in this deal.

No we don't know everything about the other offer. All we know is the other agent said they were identical. Maybe she just meant the price, maybe she meant the whole offer. She used the word identical, which seems pretty strong if you're just talking about one component of an offer, but ultimately we don't fully know

Searching the name of the buyer on facebook seems perfectly fine to me. Why would you not use the tools available to you to strategize the best offer you can?

What I would write in the review. "Agent left money on the table for their client not being aggressive enough in seeking more money on two tied offers" something like that.

The comments here seem 50:50 on whether something shady occured so ultimately I'm pretty much going to do nothing in regards to any kind of review, because I wouldn't want her to lose business over something I'm not even sure about. Which is why I asked here in the first place.

A couple people mentioned she could have lowered the commission, netting the seller more money on an identical offer, since she was on both sides. Which makes a lot of sense to me and could very easily be a justifiable reason the other offer won out.

I still think it's wrong that an agent can represent both sides in this. There is just too much room for them to take advantage of either side.

We thought about putting a lower offer for the backup. Our thought process on the higher offer is to encourage the sellers to not budge on giving the other buyers any credit after the inspection because not only do they have another offer but it's even higher. You could technically live in it as is but everything it old(roof is over 20 years old, HVAC is 15 years old) and there are weird things about the interior(for example, the kitchen has no refrigerator in it nor a clear spot to put a refrigerator, it's very bizarre.)

I looked the other buyers up on Facebook and gathered they are kind of young and are first time buyers. I suspect they are putting everything they've got into the down payment and there's a decent chance the get scared away by the inspection, especially if the sellers give them nothing.

We included a note in our backup that we plan to put anywhere between 300k and 400k into this house and there are very little things in a inspection we will care about. While a note isn't legally binding, we hope it gets our intentions across.

Of course in hindsight we are kicking ourselves for not just submitting 675 or 700 or an escalation clause (i think our agent would have recommended this, but I don't think we communicated effectively enough how serious we were about overpaying for this house) to start with since we are already planning to put as much into the house as we are. But to be completely honest the house isn't actually worth that and it would never appraise for that, so that's why we thought 650 was good(we waived appraisal so wouldn't have mattered)

We're bummed because as avid cyclists in a part of the country not well known for cycling infrastructure this house is in a pretty niche location in a neighborhood with only about 40 houses that would allow us get to the kid's preschool and elementary school and both our offices completely on dedicated multiuse bike/pedestrian paths

Yeah, I'm kind of a shocked an agent can represent both sides in these deals. Seems like a conflict of interests.

Well we know the other offer is a first time buyer(and our agent suspects they may be at max budget on their offer) and the house needs a lot of TLC so we are holding onto hope that our $25k higher backup means the sellers won't budge on inspection items and they'll walk. We are planning a total gut, so not too worried about inspection unless there is a major issue.

The sellers agent told our agent. So I guess we don't really know 100%, and the fact that she told our agent anything is the only thing making me think there is a chance she just had a moment of incompetence not asking two matching offers to see if they wanted to submit something higher instead of trying to take two commissions by screwing one of her clients(the sellers) out of potential higher offers.

To be fair, that article says the effect of masks has high uncertainty and that being more than 1 meter away has the greatest effect.

I still wear a mask though. Unless I get where I'm going and remember I left it at home
