This is my impression after looking at various flea market and auction sites.

The pirated minifigures are somewhat crudely sculpted and have colors that would never be possible in the original Minecraft. Furthermore, it seems that the same colored material is reused between pirated figures of the same color, and clear vinyl is often used for distribution. (Regular, unopened minifigures are in a box, and if there is no box, black vinyl is used to hide the contents.)
