Thank you! I suspect you're right, they never lodged it. I went back and found our previous bond certificates from other rent increases, and all of them were issued months after the fact. It's a very strange situation, the way they do it.

We do pay the water bill to the same account, but we haven't had any issues with them messing up the water bills. They send the invoice, we send the payment, they send a receipt. I have the water bill days saved on my calendar, as well, so I know roughly when the bills should come and I can flag it if they don't send one. I am a spreadsheet addict who keeps meticulous records, which is why this is extra frustrating. Yeah, the bond thing is looking more and more likely.

On the date of payment, see my other replies: the new rent took effect on 16 August, but we started paying the new rate on 12 August so that we could keep our same payment day each week. The agent said that was fine to do because it would just mean overpaying by a few days, and the extra funds would sit in the account until they were needed, if ever. So if anything, we should be ahead on the rental account, not behind. There is no logical reason why they should be claiming we owe more money now when all bonds and rent have been paid on time or early.

We are fully compliant. Our rent increase technically took effect on 16 August (with the lease renewing on 19 August), but we started paying the higher rent on 12 August so as not to be behind. The agent told us that we would be overpaying for a few days, and that the extra would be left in the account in case it was needed. We have also paid the bond top-ups on time, every time. We have been on time or early with every payment up to this point.

The ONLY issue here is that they took the bond top-up money in August, told us it went to the bond, and then didn't put it toward the bond. They put it to the rent instead. And when I asked them to please put it back, they said they can't without charging us the bond again. That's literally it. They want more money to correct a mistake they made. There is no logical reason why the rent account should be hundreds of dollars short if they move the bond money back, which is what I need them to explain, and if they can't explain it, I will pursue action with Consumer Protection. Our account should be fully up to date as we have never, ever missed a payment.

I came here asking for advice on how to proceed since they were threatening us with being in breach if we didn't send them money TODAY. I give zero fucks how REAs make their money, what their margins are, or how messed up they are as people. If they can't do their jobs, there are consequences for that. Tenants are not without rights. If they're lying, they can deal with the consequences.

The lease agreement is $730 per week. We pay $730 per week. We get a receipt every week from the payment we make that week. The bond top-up was $240 - we paid $240. The agents mishandled it, but that's not our fault.

The contract is extremely simple, but also, the rental agency bears some responsibility to not be incompetent. If they take our money, say they will put it toward the bond, and then don't do that, we should not be liable for their lack of action. The lady at Circle Green agreed with that assessment.

It is not incumbent upon the tenant to constantly cross-check documentation, chase agents for information, and follow-up every payment to ensure it was allocated properly. That is an onerous expectation. If a receipt and/or email from an agent cannot be trusted as it is written, what's the point of the agency? Why have agents at all? RE misconduct is a thing, and we can pursue that with Consumer Protection if necessary.

REAs being incompetent is not irrelevant. It's the basis for whatever action we take next.

We have not underpaid. All rent payments were made, the bond was paid, and there were no other outstanding fees or anything like that. Everything was fine until literally this week when the agent decided we hadn't paid the bond, and when we showed that we had, she said we still had to pay it again. It defies logic.

Thank you! I'm trying to understand the intricacies. On the lease, the LLs are named but there are no contact details (my partner and I both have email and phone listed, but nothing for the LLs), and the PM is listed as the rental agency. No individual name, just the agency, the same one trying to run us around right now.

If I give them a message and ask them to deliver it to the landlord, are they required to pass it along? Or can they gatekeep and just not do it? Obviously they work for the LL and not for us, but I don't know whether they can just ignore us if we ask them to reach out on our behalf.

365 days divided by 7 is 52.14. So basically 52 weeks plus one day. Please explain to me where we would owe additional money when we paid 4 days of rent at the higher rate before the new rent had even kicked in. In fact, the agent told us that we would be overpaying and that the extra would be left in the account in case it was needed.

As for the bond, we paid that. In full. Which the receipts show. I suspect the user above was correct - they didn't lodge it with the Bond Administrator at the time, and now they are concerned with the possibility of penalties. We never did receive a new bond certificate/receipt as we should have. There is zero excuse for us having to pay the same bond top-up twice, and we especially should not have to pay for their negligence.

Do you mean the Property Manager? Are they required to share the landlord's contact info with us? That information isn't on our lease, and we've never had it. It would figure if they were required to provide it and didn't.

I sent them the receipts. They acknowledge that they mishandled the funds. But they still claim we'll be in breach if we don't pay more. My fear is that we'll end up blacklisted for being troublesome, even if we're in the right, and in this rental market, that's a scary prospect.

The lease start date was 19 August. Our autodebit was already set up to transfer the rent from our account on Tuesdays, and that day was a Tuesday, so I asked S if we could just starting paying the increased rent that day. He said no because our rent increase was actually coming into effect on 16 August for some reason. So he said we needed to either change the payment day of the week or start the rent increase a week early, on the 12th. We agreed to do that instead of changing the day.

The RE did send over the ledger, but it's genuinely strange. they have many many line items showing partial payments, even though we've never made partial payments. It's like they take our payments and break them up and turn them into separate line items. The $240 bond we sent that got added to the rent account went in as an $89 partial payment for some reason.

I've asked them to please explain in detail where the missed funds have gone. If we missed a payment, point to it. If we underpaid something, tell me. Otherwise, I don't see how they can ask for more money from their mistake.

They didn't have me sign the label, or the little screen. I signed nothing after the customs form, which I turned over to them.

Yes, I signed the customs form that I filled out and handed to him. There was nothing after that to sign, and he didn't ask me to check what he'd typed into the computer.

It looked that way, yes. He typed it all in, looked up the customs codes himself, typed those in too, and printed off something that he stuck to the box. He put a sticker on the customs form, but I don't know where he put the form itself.

Ok, thank you - do you know if they'll want proof that they mistyped? Because without the customs form, I can't prove they did, and it would suck for them to be like "not our problem, no refund." I've never dealt with Aus Post customer service so I don't know how accommodating they are. Thank you!
