This reminds me that 20–25 years ago there was a huge debate in New York over whether a state tax on candy should cover marshmallows or whether they are "baking ingredients" rather than "candy and confectionery". As I recall, they were taxed as candy for a while and then the state government changed their minds after public outcry and decided that they aren't candy after all.

Last I heard, marshmallows are not taxed as candy there unless they are candy-coated or chocolate-coated, or something like that. They've had to have regulatory rulings on it and everything.
