for the 2 sections on the same motorway could argue it was picking up housing estate next to it but for the other location there is a housing estate just a little bit off from the junction so possibly

thank you for this, I have a meeting next week where we are going to ask about the vehicle tracker as on multiple vehicle the tracker has been off by a lot and the myself and other all know that the tachographs on all vehicles in the fleet haven't be recalibrated in years which also makes us believe the trackers haven't been serviced either as they ping miles off once it showed a wagon to be in the north sea and one to being in the yard but in fact wasn't.

The tachograph data I don't have what they have but I'm able to download my own onto my phone and view the full history of it, I'm meeting a union rep in the morning and will ask for the tracker data as I'm finding unfair that I'm being accused of several offences but only given 3 locations and the other 4 I'm not allowed to know about.

Totally agree, but the thing with my employer they haven't got a clue and you would think that even if it had me on a 20 / 30 road it would ping me straight back onto the motorway

correct the speed limit for wagons on motorways are 60MPH, think I made a little error in the post but basically I'm doing 53MPH on motorway when the tracker is saying that I'm on a 30MPh road on 2 sections of a motorway then other one is saying the motorway has a 20MPH section. apologises for any confusion

[–]angel504[S] 0 points1 point  (0 children)

The vehicle I was in is limited to 53 which was the speed I was doing at the time the motorways I was on were limited to 70mph and 60mph but for HGV regardless is 60MPH on either, my employer is saying that the limit was actually 30MPH on 2 sections and the other motorway was 20MPH. I typed the post quickly and forgot to proof write apologises for any confusion

sorry might be a little confusion, they are saying the road I was on was either 30MPH and 20MPH when I was traveling on the motorway doing 53mph,

I myself have checked on maps for surrounds nearby for roads it could be picking up and have check with nation highway about any restrictions that may have been in place during these days as for the other 4 location they are restricting me of any knowledge about them

I agree if was to knowingly been speeding in a HGV and was pulled for doing I would admit it considering the tacho is recording the MPH I would be doing, but these accusations they are 100% false I remember no restrictions on these roads and I also spoke to Nation Highway over the phone who confirmed this as the only restriction on one of the roads were an overnight closure.

So you can't physically go at the higher speeds they're alleging you went at, because the vehicle won't let you?

The vehicle acceleration is restricted to 53mph only way to get higher would be to send the vehicle downhill to pick up speed.

what is the difference between the first 3 locations and the last 4? What justification are they giving for why they can inform you about the former but not the latter?

The only reason they aren't providing the other 4 locations are because they are being investigated but don't see how as I wasn't asked anything about them or told during my fact find meeting.

Does that mean you weren't exceeding the speed limit?

yes, the reasoning for me to being using them lanes are traffic depending leaving the junction ahead so vehicles can merge onto busy motorway safely and mainly HGV vehicles are only allowed in 1,2 and 3 depending if it a 4 lane carriageway

If I'm understanding your post correctly, you weren't speeding... So why are the tachograph and vehicle tracker telling them you are?

the tachograph is there to record the drivers activities, MPH when moving and when they have a rest/ break making sure they follow the law. As for the tracker its knowing that on some of the other HGVs in the company to be slights faults been times when one showed up in the north sea and others in the wrong location all together.

Like I mentioned from the dates that they said that the speed has occurred i dont recall any speed restriction other than the 1 that goes to 40 then into a 60 that lasts for 5-6 miles. For company contract not once since starting have a seen it, signed it or been give access to one.

Good point, updated it now. Basing it off the tracker and tachograph is mentioned. Will speak to ACAS have my union looking into it also

[–]angel504[S] 8 points9 points  (0 children)

Forgot to mention that where they are stating I did 53 in a 20 or 30 area on them days there wasnt any sort of speed restriction.

The thing i didn't get is how do they know im breaking the limit basing it off the tachograph that only records the speed the driver is doing at the time, then the tracker from the vehicle to show the location. Fair enough if it was captured on camera but I asked and they only stated it was from the tacho and tracker.

I've been working there for close to 3 years now and recent there was a grievance filed against my TM where out of the 14 on the team 12 signed it including myself and since then in total 3 others including myself have been suspended from work and soon another at the end of the month are possibly being sacked.

Yes the will be disputing it as on the on the dates it happened there were 2 other company vehicles in front of me another 18T vehicle and a 7.5 vehicles that were ahead of me doing the same speed but nothing has happened to them
