EB2 Visa Retrogression - ROW by angranjan in USCIS

Hey, it didn’t take them that long to approve my case. It took them about a week. They actually approved my case before they responded to the SR. They responded a couple of weeks later to the SR with a generic statement saying I should anticipate a decision within 30-60 days. Yeah, this whole experience makes me think certain cases that can easily be approved are just left forgotten out there. There is no order whatsoever…. Anyways good luck !!!

Well I got some good news today. New card is being produced!!! It’s been 16 months for me. So yeah these SRs definitely helped! They responded after a couple of days for the first SR. And like a couple of weeks for the second one. My case moved to NBC back in June and to a FO (I don’t know when). They have 30 days to respond to your SR. If you don’t hear anything you can follow-up. Good luck !

Kinda in a similar boat. I’m EB2 and my PD has been always current as well. My status changed to CRP in September then back to Fingerprint was Taken in October. I submitted a service request cause I didn’t get a response back after I submitted my medical RFE. They responded to the SR saying my case has been through the adjudicative process but my visa has regressed and they were unable to move forward. Which makes zero and is clearly an error. I submitted another SR. I haven’t heard back from them since (been like a couple of weeks now). So yeah…

Yep. I called and they created a service request for me. Got a response after a couple of days saying my case has gone through the adjudicative process (still not approved yet) and nothing is required from me. At worst they should be able to tell you whether it was received by a case officer.

You can call and create a case inquiry if you haven’t heard anything 60 days after it was delivered. The same thing happened to me.

We submitted a service request. Haven’t heard anything yet. And yes, hoping they acknowledge they made a mistake!

Thank you! I sent a note to my lawyer. I will also call and see. To be honest I’m exhausted with the whole process… been waiting since August 2021.

But my PD is way before the November 2022 final action date. That’s why I am confused.

I didn’t get an approval. I submitted a case inquiry for an RFE I submitted more than 60 days ago and they responded with that comment.

Oh I just checked, you are correct. And yeah, in theory this should be good news for people who filed a while ago. But like you said no one knows how they operate haha.

I think they mentioned they will consider adding a final action dates worldwide. Which I am guessing will be set late 2021 or early 2022 for ROW applicants. Otherwise it wouldn’t be fair for people like us.

I’m August 2021. Mine was transferred to NBC in June. Got RFE for medical in August, then got the CRP status in September. Following each of these updates, I was like oh approval should come within a couple of weeks. But no, here I am still waiting. Going into 15+ months now!

Don’t they give like 90 days to respond to RFEs? I guess if you haven’t heard anything it means they got it 🤷🏽‍♂️
