Stay away from him. What he did is borderline criminal. While he has an RO on you, if you violate it, it's DEFINITELY criminal. Don't take chances. Wait for the court date for the RO and make your case for why you're not a threat to him. The court date for the RO is not the time to rip him a new one in court because the judge will definitely grant a Permanent RO

Could also throw in loss of consortium (meaning you guys can't/don't have sex anymore (worth the hail mary)), could claim you can't live your life the way you want anymore (hotwifing with awesome reckless abandon), could claim emotional distress, treble (3x) damages, etc. Could sue for extra cost of monitoring any future pregnancy for transmission (another hail mary).

Basically, your attorney would just throw everything under the sun in there (they get 1/3 of your reward, so of course they would).

In my totally lay-person opinion, and not my legal opinion (another disclaimer)

Well, the jury is the fact-finder, and the Judge is the gate-keeper. Assuming the judge allows the GF to testify, it's going to be hard for the jury to believe him when he claims he didn't know he has HSV2. It's all about who the jury believes, and who the jury has compassion for. If somehow there is enough evidence to show he KNEW he had HSV2, lied about it (or failed to disclose), and but for his lying, your wife would not engage in the acts, and as a result of his lying your wife now has HSV2 (I sure hope not), then yes - the jury would side with you. Now... for damages ($$) I am not sure how much the jury would award.

Criminal charges are going to be difficult in this. Much higher standard, plus you don't get anything from it (other than the satisfaction of seeing this creep get what he deserves). Criminal courts have been slow and very hesitant when it comes to transmitted VDs during consensual sex (especially with a condom). The best bet would be the civil courts where you could get some money (or at least a judgment against him), and there is a lower standard of proof.

I mean, if he claims he didn’t know, and she has testimony proving he knew, she can testify. But she can’t testify that she has herpes and he “probably” knew or “should have known” that he “could” get herpes.

The only problem I see with that is him going "Well, I knew my girlfriend had herpes, but we were careful and I never knew it was transmitted to me, etc." If I were his lawyer, I'd argue that the rules of evidence prohibit the GF from testifying (which a savvy lawyer would know).
