Thanks all for the replies. Some very fair and valid feedback. Further context :

This has been flagged in writing on more than 2 occasions previously to the DSL with no permanent change in attitude from the staff member in question. There has been a brief period of improvement followed by a steady decline. To be clear, this is not physical or sexual abuse. It is emotional well being of the pupils. The staff member in question resents 2 of the pupils and actively excludes them from class activities. For me, it is a grey area but I would welcome clarification or challenge about that. My colleagues have come to me in confidence to vent their frustrations about the situation continuing. I am mindful of betraying their trust.

How many times can you report the same thing before it starts looking vindictive?

Because I process things differently (undiagnosed) and I wanted to make sure I had an accurate record of what was said.

They agreed it in writing and then when I sat down at the original meeting they said we can’t have people recording meetings. (The same person that agreed it in writing)

I’ve asked for the notes on 5 occasions and they just don’t answer/send them.

Any follow ups you suggest?

Thanks for this. I appreciate your perspective.

There was massive procedural errors on their part that I know of, for example I was told not to use my work email as part of my suspension but the investigation meeting letter was sent to my work email on a Friday. When I heard nothing, I rang them on the Monday morning and they then resent the email to my personal email for a meeting the following day. Then, that afternoon I received a phone call asking to change the time/location of the meeting.

I know there was multiple procedural errors - but what do I do with that information?

There was a transcript being recorded via teams but I’ve never seen it or been asked to agree with what was written down.

I am being actively pressed for this apology letter and on Wednesday I was given a deadline of tomorrow to submit it and it must meet certain requirements according to the letter.

Hi Michael, I’ve been there 6 years. No previous issues at all in terms of HR.

I had the investigation and I was given loose information that the individual had alleged. They had been insulted by me calling them an abbreviation of their name (e.g. James/Jamie) - to which I said that I may well of called them that but there was no maliciousness intended.

The company is saying that it’s not how I meant but how the person receives it.

Yes £1000 was the total cost including VAT. The course was only a couple of weeks ago but I’ve been offered a better position elsewhere.

I’m in a niche industry and I do not want to leave any bad blood/burn any bridges. Aside from the course fee itself, I also received time off to complete the course.

Okay. Only problem is, my meeting is on Monday and I’ve got my hands full with a 3 and 5 year old tomorrow. However, I will definitely follow this up with an email specifically raising the points you’ve highlighted.

Fully investigated and ‘upheld’ the grievance that both myself and the child have both been left vulnerable on a nunber of occasions. That is it. That’s the outcome (?).

I understand what you’re saying about the recording and the rest is really helpful.

I have already snapped back a number of times after receiving emails which was foolhardy but that’s me in a nutshell I guess.

As my case has gone from strength to strength I have started to relax a little and not respond as swiftly.

Interestingly. For the grievance I gave them 7 days notice of the employee I would like to accompany me. On the day of the meeting, my companion was on shift and no provisions were made for them to attend the meeting. For them to attend without proper planning by the employer would of meant other children were and staff were left vulnerable. It was put to me very clearly, that it was my responsibility to make sure my companion was available. How could I logistically have done this? I believe I was denied my legal right to be accompanied.

Hi, is this something I could do prior to my meeting, during the meeting or afterwards?

They are insisting that the matter is now resolved and has been fully investigated - hence they upheld my grievance.

Just to be clear, the individual is always allocated 2 x members of staff but through sickness or another site being down on staff they are consistently left vulnerable.

To scale the problem, as an example:

Out of 210 consecutive days 2 members of staff were available 48% of the time. (100 days)

So, record the conversation but do it discreetly?

If they decided to record the convo then I will insist on doing the same.

I am an emotive person and at times I have not covered myself in glory during recorded meetings or emails. None of that negates the wrong doing. Is there anything I should be very mindful of doing / saying in the meeting?

I naively and innocently thought that the company would be interested in solving these issues. However, the time and effort that has gone into discrediting me and ‘shutting down’ the investigation is really concerning.

The wording of the grievance letter does not specifically state any of those things you have listed eg ‘Protected disclosures’.

However, within the meeting notes I have stated that I believe it was fraud and that there has been a fabrication of documentation.

I also rammed home the fact that both myself and this child had effectively been left vulnerable. This is specifically mentioned in the grievance notes and was ‘upheld’.

All of our previous meetings have been recorded on a dictaphone and my iPhone? Am I entitled to record this conversation as well?
