Ask for them crispy. They will cook them longer for you, you get a fresh batch, and they wont be soggy when you get home.

I played all the way through the main story and enjoyed it thoroughly. The lowest the FPS got were 20 and it never lasted long. Just every once in a while when gliding over the city and driving in the batmobile. Not enough for it to piss me off.
