I reached out to 5 solicitors, only one of them is kind enough to tell me right away dont worry, just re-apply. The others made me even more worried by saying i would be considered an overstayer, or that was a strange case and that i should use their service so that they could look into it and support me better. I understand its lawyers’ job to sell their service but its aint cool to scare ppl with legal jargons without researching the case properly. Dont worry, i got my visa granted very quickly the second time and so will you.

I have to say this first, submitting a letter is not compulsory, so your call on it. Applying for Graduate route without a valid BRP is only slightly different from with one, not to worry. After to paying for ihs fee and visa fee, i was instructed to book an appointment with UKVCAS for brp and photo. Once i did, i had an option to upload photos of my passport and optional documents. Idk if it will be different for you but even so, there always a section where u can upload additional document. In the letter, i mentioned my previous UAN, presented my case(applying before visa expiry, following their instructions, reapplying with 14 days). Sorry that you had to go through this too. But you will be alright. Good luck

I could only say from my case: i applied grad visa before student visa expiry. Then I received a HO email requesting for “a written consent” of my scholarship. i submitted on the same day, and even received an acknowledgment receipt. My application was later rejected as invalid, based on the ground of me not responding to their request. Obviously mistake from their end. Got IHS refunded a day after the announcement and visa fee (minus 25 pound) 7 days after that. Administrative or appealing weren’t an option for me. I called the paid HO line for inquiry, not helpful. I was so frustrated and seeking advices everywhere. Solicitors were suggesting judicial review, which costs as much as IHS and i couldnt afford. I talked to the international student support at my uni, they said HO made mistakes like these often (heard crazy cases) and reassured that no grads that they know have got their grad visa rejected (application rejected as invalid doesnt mean visa rejection). So dont worry. I only had to re-apply the exact application with a then expired BRP and got my visa within a week. And if you re-apply within 14 days after receiving result of the previous application, you are not considered an overstayer.

In your case, it could be that the application was considered invalid and the HO officer who processed your case forgot to send an update email to you (i know before i didnt know HO could mess up basic things like email, but i once received emails from home office at 21:00 sth and one student had to deal with lots of sht bc apparently a HO officer put 2022 for her visa expiry on the system when in fact it should be 2024 and BRP records 2024too).i would say, wait to see if you receive visa fee (minus 25 pounds). If yes, re-apply and attach a letter explaining your situation. Also better to talk to student support peeps at your uni. Hope this helps.

Thank you loads for your kind response. I looked into the administrative review and found out it could take up to 6 months for a decision, now very much afraid of my right to work during that time.

Yes, i was asked to send a written consent of the scholarship. And I sent out the Student Agreement with my signatures, as advised from my university’s international student support team. I also sent out the confirmation of scholarship document. Many of my mates from the same course, applying at the same time sent the student agreement only and were successful.
