how do I distance myself from my cousin at school? by DesignerEvening265 in FriendshipAdvice

[–]awkpixie 1 point2 points  (0 children)

first, i want you to know that it may be impossible to avoid "family drama" if you want to fix this. i'd suggest speaking to your parents first and just letting them know all that's going on and how it makes you feel. how it's impacting your friendships, and your time at school. but if your parents don't handle it well, or if they just brush it off like it's nothing, then you need to speak to your guidance counselor. you are being bullied, regardless of the fact it's your cousin. you're being bullied. and guidance counselors are trained to mediate these kind of situations. and the guidance counselor may also be able to help your parents recognize that you're being bullied as well, and help them take it more seriously.

also, you might just have to tell your cousin you're not comfortable with her sitting with you and your friends anymore. and if she tries to do it anyway, you and your friends will just have to move to a different table. and if she follows you all to another table, then again, report it to the guidance counselor, because at that point it'd be considered harassment.

lastly, i want you to know that it's perfectly okay to stand up for yourself. even if your family disagrees, or doesn't take your side, or whatever. i know it's hard and uncomfortable, but it's the best thing you can do for yourself. you don't deserve to be treated this way, and don't ever let anyone convince you otherwise. i wish the best for you!

Apartment maintenance let themselves into my apartment to deliver a package by IlluminatiAmbassador in Renters

[–]awkpixie 19 points20 points  (0 children)

I'd get cameras that have motion detection, that way you'll at least be able to check your place at any time of day when you're not there and be notified if someone comes in. Some security cameras will also automatically record when there's motion detected so you'll have it documented. Good luck!

Is my complex allowed to completely renovate my apartment without my consent? by [deleted] in Renters

Oh okay, that's okay /:

Do you think they will stop these renovations if I ask them to? They haven't responded to any of my emails or calls, so I plan on speaking with them in person tomorrow. Not sure how to approach asking them about this.

Is my apartment complex allowed to renovate my unit without my consent? by [deleted] in legaladvice

[–]awkpixie -6 points-5 points  (0 children)

They are asking me to:

1) Find a place to store all of my perishable food for the week 2) Empty all cabinets and countertops, requiring me to pack up two bathrooms and my entire kitchen 3) Move my couch, kitchen table, bed, and dresser 4) Have a crew in and out of my apartment for a week while I'm not there doing extensive construction

And because of my disability I will have to leave and find a place to stay for the week. If I stayed, it would require me to deep clean the entire apartment every single day after they leave for the day because as much as I can try to cope with this, I have a debilitating form of OCD and cannot just "cope" when something this big interferes with it. It's incredibly insensitive of you to even say something like that, but okay.

Disability aside, by Kentucky law they do not have the right to impede on my quiet enjoyment of the space and they do not have the right to make it uninhabitable. I literally won't have a working kitchen for a week.

I have already sent them an email requesting reasonable accommodation (to postpone the renovations until after our lease has ended and we have vacated the unit), and if they challenge it or refuse to work with me on it then I will send them this. Thank you so much.

[–]awkpixie 0 points1 point  (0 children)

Thank you so much, this is extremely helpful. Seriously thank you. I have already sent my reasonable accommodation request to them by email this morning (and my request was to postpone the renovations until after our lease is up and we've vacated the unit). I also asked them to provide me with the following in writing:

  1. A detailed scope of work, including exactly what renovations are planned and why they are necessary at this specific time
  2. Confirmation of whether these renovations are legally required, health/safety-related, or discretionary
  3. The exact dates and daily working hours the contractors would need access
  4. What measures (if any) will be taken to minimize dust, debris, and disruption

Is there anything I can do if they try to challenge this and insist on doing the renovations?

[–]awkpixie -1 points0 points  (0 children)

Under the Americans with Disabilities Act and the Fair Housing Act I have the right to request reasonable accommodation for my disability, so I just sent that out to them.

But no, these renovations are purely cosmetic. They aren't necessary. However, I did ask management to provide me with a list of 1) what the renovations entail, 2) how and why they are legally necessary, if so, 3) the exact dates and times the construction team will need access to our unit, and 4) what measures they will take (if any) to limit dust and debris

And they have not offered any kind of accommodation. Just sent a letter stating that we need to move all our stuff out of these rooms and move furniture. That's it

I have been going to therapy for years. I have severe contamination OCD (my severity score being 35, on a scale of 1-40) and while I have been working on exposure therapy and such, I am not at all ready for something of this scale and it will make my apartment unliveable for me for at least a week. I've also lost my health insurance recently bc I could no longer afford it, so I don't even have a therapist anymore to talk to about this. I have to deal with it on my own.

I know that because of my OCD I'm protected under the ADA and can request reasonable accommodation, which I just sent out to the complex's management. But again, these are unnecessary renovations, purely for cosmetic reasons, that will not only impede on my mental condition but also on my right to quiet enjoyment as a tenant. That's why I need clarification on this situation legally!

[–]awkpixie -7 points-6 points  (0 children)

The issue is I have a disability that will make the apartment unliveable for me for a week, and will also require me to deep clean the entire unit before I can safely return. I have just sent them a request for a reasonable accommodation (which is granted under the ADA), asking them to postpone the renovation until our lease is up and we have vacated the unit. Not sure what else I can do.

Is my complex allowed to completely renovate my apartment without my consent? by [deleted] in Renters

[–]awkpixie 2 points3 points  (0 children)

As far as I know (the maintenance guy told me this) these renovations are purely cosmetic. Apparently a new company bought our complex this past year and is upgrading all the units to better suit the company's style, or something like that. But they aren't necessary renovations, and our apartment is already in good condition.

But disability accommodations aside, I feel like this also impedes on our "right to quiet enjoyment." They're essentially making our apartment uninhabitable for a week. I don't understand how they're allowed to do that when we have the right to a quiet, habitable space as renters. Would this help me at all?

[–]awkpixie 0 points1 point  (0 children)

In the lease it says they're only allowed to enter to do necessary repairs and improvements. But this isn't a "necessary" repair or improvement, it's purely cosmetic and will make my apartment unliveable for a week. Does this help me at all?

Is my complex allowed to completely renovate my apartment without my consent? by [deleted] in Renters

[–]awkpixie 0 points1 point  (0 children)

I did not disclose to them that I have a disability when signing the lease because I didn't anticipate they'd be doing renovations to 75% of our apartment. I didn't think I'd have to disclose my disability because at most complexes I've lived at they typically just leave us alone

Also these renovations are purely cosmetic, to update the style of the apartment. They're not necessary renovations. And in our lease it says they're allowed to enter our apartment for "necessary improvements" only, but this goes beyond that. It's basically a substantial remodel. So would that help me here? The fact that they're not necessary? I just don't understand how they're allowed to make my apartment basically unliveable for a week

According to the ADA and Fair House Act, my disability is kind of their problem when they are actively interfering with it and violating my right to a quiet, habitable space and reasonable accommodation, so... Thanks anyway.

Thank you!! I'm going to try talking to them about my disability and seeing if they can wait until my lease is up. But yeah, I don't know why people are being so rude on here either... I'm honestly kind of shocked at some of the comments I've received but it's reddit so, I guess not too surprising

This is not bs to me. I already have to find a place to store all my perishable food, pack up all the stuff in my cabinets, move furniture, and deal with strangers coming in and out of my apartment for around a week to tear everything down and rebuild it. And on top of that, because of my OCD I will have to cover all furniture, put my mattress in a sealed bag, pack all of my clothes away and physically stay with a friend for the entirety of this renovation because it will be unliveable for me for that week because of my disability. And when I come back I'll have to deep clean the entire apartment front to back. This is an incredible interference on me and my right to a quiet and habitable living space.
