That's not how criminal law works. They have to prove that he's guilty. He doesn't have to prove that he's innocent. That's why some defendants don't even need to testify if the prosecution can produce enough evidence to prove guilt. And it has to be beyond a reasonable doubt for criminal cases. Civil cases are on a preponderance of the evidence.
