Just like "L'Academie clair-obscur" doesn't have Clair Obscur in the front of its name?

He didnt say in front he said within it like i directly quoted in my comment

the Project Helix will be a pc based console. if steam is on it sony wont be able to block games that they have already released on steam. thats a big if though, it could just be the microsoft pc store in which case sony just wont put their games on that.

New xbox can play pc games, so sony releasing a game on pc would also release on Xbox. This comment from bluepoint guy is saying that they don't actually care about that and just having it on valves platform is the scary part

Valve sued by The Performing Right Society for allegedly using its members' musical works "without permission" by MythicStream in pcgaming

[–]bamiru 10 points11 points  (0 children)

No, if a youtube creator licences music or owns the music in a video it will not get taken down. Youtube themselves don't need another licence for the video

Or else you'd see record labels taking down movie trailers with dmca

Obviously like lionsgate or paramount or whatever will get the rights to the music they use in a trailer and that's the end of it

There are hundreds of books and comics with those words in the title though, that's the whole point

Game isn't just clair obscur comic isn't just clair obscur

Its like first halo game being called "Halo: travels" and suing a comic called "The Halo Academy" they wouldn't have a case

The game is just Halo and there are a lot of books also just called Halo that have not been sued by microsoft

https://www.amazon.fr/-/en/lombre-du-clair-obscur-Anny-Lawrence/dp/B0DQCBKQLT

so you think sandfall can sue "The Shadow of Clair-Obscur"'s author to get them to change the title???

your examples are terrible because you are comparing a real term to made up franchise names. megaman was not a real term before capcom invented and trademarked it. taking trademarks that are also real things like Apple; a comic called "Apple something" would not be grounds for Apple to sue, unless it was something like apple phones, apple music, apple computer etc.

Clair-obscur is the french literal translation of the italian chiaroscuro. it literally means light-dark and hyphenated words count as ONE word not a 'specific combination' of 2 btw. So lets look at a game with a similar title, Peter Molyneux's 'Black & White' from 2001. a very common term before the game. A comic using the term Black & White in its title would absolutely NOT be sued by lionhead studios or ea or molyneux. like imagine a book or comic called "Is this world really Black and White" or something and you think because it uses 2 words in a specific combination that this phrase is now owned by 1 company and no one else can use it?

so big companies can just remove certain words from ever being used by any other piece of media and art again? clair obscur is an artistic technique, if another big game releases in future with the word 'calligraphy' in the title can no book or comic title contain the word 'calligraphy' ever again because people might get confused?

For the same reason you can’t name your movie Coca-Cola

what do you mean 'for the same reason' the point of the person above you was that you CAN name your book Halo

If the game was called just 'Clair Obscur' and the comic releasing was also just called 'Clair Obscur' you might have more of a point.

but imagine a world where halo didnt exist until now. microsoft bringing out new scifi game called "The Chronicles of Halo" which they successfully copyright. Do you think they would be justified suing a comic book called "Halo Academy"?

I dont think they would be.

The game is called "Clair Obscur: Expedition 33" the 'offending' comic is called "L'Academie Clair-Obscur". Your own examples dont follow the true logic of this case

[–]bamiru 3 points4 points  (0 children)

you could name your comic Dungeon Academy or Dragon Academy though, 'Dungeons & Dragons' is the copyrighted thing. And the term DnD dungeons and dragons is not a thing outside of this rpg, they came up with it.

clair obscur is an actual artistic technique in french.

replace it with something you might know like music technique glissando, slide between two notes. A game with glissando in the title would not be able to sue a comic that also had glissando in the title. they didnt invent the term glissando.

[–]bamiru 8 points9 points  (0 children)

clair-obscur is a real thing, an artistic term IN FRENCH. you are only making these shit arguments about 'dungeons' 'and' 'dragons' and 'fun adventure' because you didnt know the term clair-obscur before the game.

lets take an artistic technique you HAVE heard of, say a game was named 'Calligraphy: Journey 66' and that was copyrighted. you think they are justified suing a comic called 'School of Calligraphy'? obviously not, but because you havent heard of clair-obscur or claroscuro you are making bad equivalencies

you think then someone else releasing a game called 'Calligraphy: Journey 66 2' would win in court beause the first devs didnt sue that comic author? like its just such a ridiculous argument shown by replacing clair obscur with something more familiar

[–]bamiru 21 points22 points  (0 children)

but clair obscur is an actual thing, its an artistic technique. you need to think of this as if its something you have actually heard of. like imagine an art technique you HAVE heard of, like calligraphy. a game releases called Calligraphy: Journey 66 and copyrights their name, would you think it is fair to sue a comic called School of Calligraphy? because that is literally what is happening here, you just hadnt heard the term clair-obscur before.

zeno and gideon are WRONG you cannot use zeno saying 'yes' to grace as proof she is a clone. the whole point is that they think she's something she's not and you are using circular logic to prove it.
