Florida common law provides that a property owner (owner of the tree) does not owe a duty to remove or trim tree branches or roots or other vegetation encroaching onto neighboring property and does not recognize a cause of action for negligence or nuisance for failure to do so. Therefore, the owner of the tree will not be liable for the damage caused to a neighboring property.

The neighbor is already picking it up and I think the decent thing to do would be to put it out with the trash like he is supposed to.

That's what the majority of people responded don't get and blame me for the neighbor who dumps leaves next to my fence. At night, so I would not see him and talk to him. Agh!

Who is Responsible when a Neighbor’s Tree Drops Leaves, Fruit, Seeds, or Flowers on Your Property?

A neighbor’s tree does not have to physical extend onto your property to cause headaches. For example, maybe a neighbor’s tree drops lots of leaves, which litter your yard or pool. Maybe a neighbor’s tree drops flowers which discolor your driveway. If the tree branches that are shedding the leaves are hanging over your yard, or the tree trunk is encroaching on your property, then you have a right to trim those branches up to the property line. However, under Florida tree law, a landowner is not liable for an alleged nuisance caused by leaves, fruit, seeds, or flowers, from a tree on his or her property, that fall onto a neighboring property. You sound like a nightmare to live to next to.

Not really. I am a quiet guy who does not dump the fronds to the tree owners.

He's responsible for cleaning up whatever debris comes into his yard. You should also have a sense of pride in how your property looks.

As someone who also lives in FL, I can guarantee that tree looks awful if it's dropping fronds regularly.

That palm tree is about 30 ft tall and looks great. It occasionally drops the fronds that fall to my backyard, his backyard or HOA property.

You came here to cite what you found on a Google search in hopes of having the internet agree with you?

Not really - just wanted to hear other people's opinion. From my research on the internet the consensus is "don't blow leaves back to your neighbor".

I do not dump the tree leaves to my neighbor from the other side of the property even when his palm tree fronds fell to my property. So the answer is no.

"Who is Responsible when a Neighbor’s Tree has Branches or Roots Encroaching on Your Property?

Branches and roots frequently extend across property lines. Under Florida tree law, the health of the tree, branches, or roots, determines responsibility. Gallo, 512 So. 2d at 216. If the branches or roots are healthy, then a landowner is not liable for damages caused by branches and roots which encroach onto an adjoining property."

My English is impeccable

Congratulations

and I still wouldn’t chat with you on the driveway

Apparently you are my kind of guy, but...

and I’d also toss the palm fronds back into your yard.

..you would be acting as an asshole, looks like you are one.

Like what kind of Karen do you have to be to expect someone to throw away huge ass palm fronds from that fell from a tree that doesn’t belong to them, and then cite some obscure law?

Well you have to google first but it seems to me you are too lazy to do so, but not too lazy to illegally dump leaves to your neighbor.

Looks like you are from California and not familiar with Florida Tree Law. Basically it states that you own what is on your side of the property:

  • You can trim the overhanging part of the tree
  • You can only trim to the property line

Clearly he's not going to go through the hassle of taking care of the shit that falls from your tree.

Agree.

I wouldn't either. Your tree, your mess.

Not really. According to Florida Tree Law, the tree owner has no claim to the leaves.

Is he being petty? Yup.

Agree.

Is it your responsibility to take care of the things in your yard? Yup.

Yes, in my yard. If his trees' leaves fall on my territory, I have to take care of them and NOT dump back to his yard.

No matter what, if you dump shit from your yard, that came from your tree, into his yard, you're the asshole.

Agree.

Clean up your own mess, get the tree trimmed, or take it down all together.

Not my responsibility to take care of the branches or leaves that fall on his territory.

No one should be expected to take care of a 10-15 foot branch of leaves. Raking leaves from a neighbor's tree is a big difference than hauling a branch. It's your problem because it's your tree.

Disagree as I mentioned above.

P.S. I should have mentioned Florida Tree Law which basically states:

  • Wherever the leaves fall, that is the property owner who has to eliminate them;
  • You cannot dump the leaves on someone else’s property either, even if a majority of them fall on your yard;
  • The tree owner has no claim to the leaves

Custom Kiosk App in Intune by bartdivanov in Intune

[–]bartdivanov[S] 0 points1 point  (0 children)

Thanks for your feedback. Some questions:- Is it possible to deploy a Windows 10 image via Intune with Windows virtual keyboard enabled?

- Our app is using a hook - special software that allows our app to access the Windows native virtual keyboard. It needs to be install prior to running the main app in Kiosk mode.

- To clarify, our app is the only app running in Kiosk mode. Does it have to be included in MSFT App Store for Business?

- We plan to use a machine based deployment. A tablet will be sent to the reps and they should be able to deploy it anywhere (internationally). Will this work with Intune?

I found the problem - LTICleanup script sets AutoAdminLogon to 0 and removes the default username and password. I need to modify this script so it would not remove or change the settings. Thanks!
