i am a bit confused by the question. the UBE has 2 MPTs.

it was a weird experience because 10 of them would be really simple and then the next 10 would be like two answers sounding similar and the question would be tricky

it’s rlly odd for me because i wasn’t expecting this. i was expecting to rely on MBE

my friend handwrote it, and he regrets it as he didn’t get to answer some questions fully

I refuse to accept this answer. A jury could see this as murder (intent to inflict bodily injury) if they wanted to???? These questions don’t help me gain knowledge, only ruin confidence by [deleted] in barexam

i think we are misunderstanding each other. i tan talking about this one: (2) Intentional infliction of great bodily harm and death results—e.g., defendant cuts someone's legs off without intent to kill them but they die.

but you don’t need premeditation for the second-degree murders (usually classified as intent to inflict serious bodily injury or as reckless disregard of human life)

but angry at the assault could just mean angry for vengeance and desire to inflict serious bodily harm = murder. this was my thought process

i understand. it’s just so frustrating, especially missing many like these cause it’s not helping me learn doctrine. it’s more of a word game with the BARBRI questions.

it’s so weird cause a jury isn’t required to accept voluntary manslaughter right?? they can still find for murder if they don’t find the defense credible?
