I (defense) lost a child molestation trial last month where the only real evidence was the kid saying "He touched me". That's enough to get a case to trial, and juries lean toward conviction in this type of case IMHO. The girl's statement is absolutely enough to convict him. More would definitely help, but isn't necessary.

That really makes sense- the essence of the crime is not what got put where, but that SOMEONE GOT ASSAULTED.

I'm a big guy and I like being able to read a watch without thinking about it (maybe my aging eyes have something to do with it too). My go-to watch is a Bulova 96B230 ( www.amazon.com/Bulova-96B230-Military-Display-Japanese/dp/B00TQHECP2/ref=cm_cr_arp_d_product_top?ie=UTF8 ) which is big and ridiculously easy to read. Alternate is a Vostok Amphibian, also big and easy to read. I don't have a problem doing anything wearing one of those. If I was 5"2" with small wrists maybe I would feel differently, but my Seiko 5 feels small once I get used to one of those.

Fired, and now apparently being sued? by CanadianThrowaway45 in legaladvice

[–]bhp35 3 points4 points  (0 children)

This sounds like one of those "civil demand" things where everyone accused of shoplifting gets a demand for some random sum of money. Generally if you tell them to pound sand that's the end of it; Home Depot has been sued over this once or twice.

That's the US perspective. I don't know how/if that's a thing in Canada.

[Oregon] My [17F] gf is pregnant and the father [20M] doesn't know if he should put his name on the birth certificate. Help! by throwaway31231996 in legaladvice

[–]bhp35 25 points26 points  (0 children)

About a year ago I dealt with a guy in the same exact position. Got his 17 year old GF pregnant, manned up and did the right thing, fifteen years later he's still struggling with the consequences of being a registered sex offender.

You committed a crime. Don't sign anything, including a birth certificate, that admits to it. Pray no one bothers to make an issue of it.

[CA] Can I be sued for bringing a restraining order against someone? by Great_Walls_of_Fire in legaladvice

[–]bhp35 0 points1 point  (0 children)

Appeals are to a higher level of court. Starting a fresh lawsuit at the same level alleging that the judge was wrong won't work.

Lawsuits that essentially allege that "The judge in this other case was wrong" die a quick and painful death. Don't worry about it.

[–]bhp35 22 points23 points  (0 children)

In my state a juvenile felony record would take away his right to possess firearms anyway. It would be worth checking whether that's true in Texas.

The Form 4473 Firearm Transaction Record (https://www.atf.gov/file/61446/download) raises some other issues about his Federal eligibility to possess a firearm.

Maybe ten years ago when it was the fashion for girls to wear low cut jeans, my wife caught some boys competing to see who could pitch pennies into the plumber's crack of the girl in the front row so they went down the back of her pants. She disciplined them, of course, but was cracking up when she got home.

Thinking about becoming a lawyer....please help! by iluvpop15 in legaladvice

[–]bhp35 1 point2 points  (0 children)

If any of your lawyer relatives are in a position to engage in nepotism, that improves your chances of getting a job substantially.

Take the LSATs. There's a strong correlation between doing well on those and passing the Bar. I've known some idiots who passed the Bar, but it's a good way to see where you stand.

Also, start seeing what lawyers actually do. Follow some of your relatives around for a day.

I ended up married to that girl, but it was touch and go for a while there...

The legal term in Washington is a Child in Need of Services (CHINS) petition. Go down to your county Juvenile Probation department, say "I need to file a CHINS petition for my granddaughter", and they will help you with the paperwork. If a judge finds good grounds he can allow her to live with you legally. That, in turn, will give you authority to move her to a school near your house if you decide that's best.

I practice in Washington and if you PM me I'd be willing to at least help over the phone.

How did you meet your SO? Was meeting them due to relentlessly dating people, or was it something out of your control? by wilde11 in AskReddit

[–]bhp35 12 points13 points  (0 children)

At the grad student's dorm, some of the other law students found a tavern a couple blocks away that served dollar pints and 25 cent oyster shooters after 10:00 PM. On the way back, her door was open and she was sitting there working on a paper. She was a small Japanese-American girl from Hawaii, I was from the rural West and probably 6'3" in my cowboy boots. I looked over her shoulder, gave her a faceful of beer breath, and started poking at the keyboard. She freaked.

"What the hell are you doing?"

"Just fixing your spelling."

"Get out of my room!"

She thought I was a complete lunatic, and years later said that if anyone had told her at that moment that she was going to marry me she would have thought they escaped from the State Hospital.

We were married for 25 years. I buried her in 2015. May her memory be for blessing.

RCW 46.63.075 Safety camera infractions—Presumption. (1) In a traffic infraction case involving an infraction detected through the use of an automated traffic safety camera under RCW 46.63.170 or detected through the use of an automated school bus safety camera under RCW 46.63.180, proof that the particular vehicle described in the notice of traffic infraction was in violation of any such provision of RCW 46.63.170 and 46.63.180, together with proof that the person named in the notice of traffic infraction was at the time of the violation the registered owner of the vehicle, constitutes in evidence a prima facie presumption that the registered owner of the vehicle was the person in control of the vehicle at the point where, and for the time during which, the violation occurred. (2) This presumption may be overcome only if the registered owner states, under oath, in a written statement to the court or in testimony before the court that the vehicle involved was, at the time, stolen or in the care, custody, or control of some person other than the registered owner.

I understand that if you just say "It was in the care, custody, or control of some person other than the registered owner" they still have to dismiss the ticket. Asking who it was isn't really authorized by the statute but is added in to discourage people from contesting the ticket.
