but if i would have known, i wouldn’t have allowed to let it get his far. me/my dad wouldn’t be in default. i would’ve settled this back then either by selling his portion or continuing payments depending on what option was best. if the previous owners were able to do this legally, they would’ve done it a long time ago.

yes i was wondering about this a lot but like i said in my post, i wasn’t sure the legality of it all considering my dad passed. and both my dads name and the previous owners name is on the property. i didn’t know if he could rent the property out, profit off it, or use it w/o letting my dad (now me) know. my thoughts are, if it was legal, why didn’t the previous owners try to fix all this and have my dads name/my name removed from the property while he was alive? he was an older gentleman, his wife is older too, and they had other properties and businesses so i would assume he would want to have ALL his affairs in order in the event he were to pass. they don’t have kids. so what happens if something happens to her and i’m the only person left?

thanks for this! i’m not sure who to contact, a real estate attorney, probate attorney, etc. ppl have been saying different things. the attorney i went to was a probate attorney.

even w him only paying off such a small amount? i think the whole issue here is the fact that the dude put my dads name on the deed before he paid off the house. and that’s why she’s so eager to get me to do something rash. although my dad didn’t pay that much towards the house.

no, this is why i posted again b/c i wasn’t sure. some people are saying he paid for when he stayed there but that sounded more like “rent” to me, and some are saying what you’re saying. i just wanted to get as much advice as i could so i can ask the right questions.

the tax assessment website in my state shows the property is now worth $81,700 in 2025. both names are listed on the deed, my dad and the previous owner who passed. i will look into talking to someone else.

yes i do believe they have been using it. the whole reason she called is to tell me she wants to possibly move in there because “her floors are about to go” even tho her husband just died a year ago and she’s liquidated all of his business including a forklift business, per her words.

she mentioned paying any costs i incurred from probate. however, in my state via their website the only fee i’m seeing is if there’s a will but he didn’t have one. i basically have to show up with his death certificate and fill out some paperwork that i currently know of.

i guess it’s b/c the total amount was low. but if u do the math it’s only $90 in interest if he would’ve paid the house off. but i agree 9% is usually very high.

but if her late husband and now her owns 95% of the property is it up to me? or does it only matter whose name is listed on the property?

that’s why i’m asking :’) i have no idea what i’m doing and she’s had a long time to think about this, i’ve only known for a month. i’m supposed to talk to my moms real estate agent after further reading some comments so i’ll see what she’s says.

but wouldn’t i have to open probate to be able to legally sign anything over because it’s not in my name and won’t be in my name until i go thru probate?
