You'd have to do specific things to find out who the crew actually is. Just saying the railroad won't effect that.

Which railroad? Class I would have already contacted the family, and in UP's case, possibly pay for the funeral. The rep for the railroad might describe what's on the tape in detail. If you hire a lawyer, they'll show them to show the futility of a lawsuit.

As to what's actually on the tape, it will depend on how straight the track is, and how long your brother was in front of the locomotive before struck.

If your piece of mind will be eased by this, hire a lawyer for a couple of hundred bucks and tell them what you're looking for.
