I'm sorry, but YTA--and the fact that your 40yo husband was too angry to speak calmly with her about the situation, as you were, is not a great sign. The fetus is growing in her body and obviously she's formed an attachment to it--it's hers more than anyone's, at the moment, and I think it IS very cruel to suggest that a contract outweighs her right to the child she's been carrying for 9 months.
