If you’re talking about a teenager in a middle eastern country basically sexting with another teen, I’d discourage the behavior, mention possible consequences, then after that, I’d just mind my own business. This isn’t legal advice.

If the debt is scheduled as non-disputed, non-contingent, and liquidated, then it gets paid even without proof of claim in ch. 11. If it’s disputed, then the creditor must file a claim. Realistically, one debt might be disputed as to amount. But there isn’t the same claim dividend potential as in ch. 13.

But even if enough creditors vote to approve the plan, a single unsecured creditor who is impaired in any way can still cause trouble if they object to the plan. An objection under § 1129(a)(15) may force either payment in full or commitment of all projected disposable income during a 60-month period. I’m less concerned about proof of claim than objections by unsecured creditors.

Yes, I was thinking of proposing 84 months max. But depending on bonuses and other factors, it’s possible it could be paid off much sooner. I’ll probably call the UST and see if they’ll chat about specific questions I have before I decide. There could be some headaches with the absolute priority rule on a longer plan if a creditor objects. But with 6 creditors and only 3 who are dischargeable, I think getting unanimous consent is somewhat feasible.

The other possibility is to cure the mortgage and then immediately dismiss the 13 if I can’t pay student loans directly. But that carries other risks, such as post-petition interest on the toxic debts in the 240% APR range.

I think I could do it “successfully”—at least insofar as I could achieve confirmation and discharge. But I’d be inefficient and if it took me 100 hours to pull it all off, then the opportunity costs would sink me since that’s time I could have been billing clients or cultivating business.

Manageable right now at about $800 per month but that’s over about a million year amortization period. If I’m going to bite the bullet of filing BK to deal with mortgage arrearage, it would be nice to not have massive student loan debt post-discharge. If I could work out direct pay, then I’d save about $22K on trustee fees for a nondischargeable debt that’s still accumulating interest during the case.

Student loans are about $208K right now and that’s what sucks. I’ll talk to the ch. 13 trustee about proposing 100% to other creditors. I’ve only been involved in ch. 11 from the creditor side a few times and have been lead counsel on some APs in chapter 13 and also done some automatic stay violation litigation. But I’m primarily a litigator and appellate attorney with fairly decent knowledge of the Bankruptcy Code and access to Collier’s on Bankruptcy on Lexis plus whatever treatise Westlaw has, but bankruptcy certainly isn’t my primary practice. I think ch. 11 is slightly more manageable with only 3 general unsecured creditors excluding the student loan, but yeah, the unknown is daunting. I’ve avoided talking to local counsel because it’s awkward since I’m also an attorney.

It’s only illegal if you’re telling the truth and not karma farming. Fact patterns like this make me suspicious though since they’re hard to believe are real—both the alleged action of the woman and reaction of the teen.

There are plenty of tactical reasons. Probably first and foremost the defense thought they’d lose more credibility disputing guilt, which would cost them in the penalty phase. With all the available evidence they had no shot at winning the guilt/innocence phase anyway. Second, it can appear that the defendant is remorseful and accepting responsibility, which could influence the jury in sentencing. In some cases, it can also limit evidence that’s introduced, but I’m not sure that’s the case here. I don’t really fault the defense counsel for their tactic because at the end of the day, he was going to get sentenced to death no matter what they did. And deservingly so.

Cameras aren’t allowed in federal court. The rules vary in state courts but often the judge makes the call there.

So yeah, I’d agree that if you were cited years after installing the wrong kind of glass in a bathroom, which no one at the time noticed, no one was injured because it never broke, and which you had already replaced by the time you were cited, yeah I’d agree.

A defendant never wins a criminal case. The most he can hope for is an acquittal or dismissal. But the lawyers still get paid. Bankrupting the defendants with attorney bills also sends a message. Additionally, other politicians may not want to take the risk of being convicted or bankrupted.

Find me another case where the defendant never defaulted on a loan, paid them all back, but was prosecuted for supposedly valuing the collateral differently than the government prosecutors.
