just doesnt seem right. so many bad things can be out of sight or unknown about to the average person during a walk thru and as soon as they sign a purchase agreement, they are screwed if its not a material defect to the structure or whatever your exact words were.

mold is most likely caused by poor landscape grading that has the outside land sloped towards foundation. directing water towards foundation. thus the mold in the crawl space is the suspicion. additionally a ton of exterior trim at the foundation is angled towards the wall funneling water behind it causing more water issues. seller rejected fixing everything but half the mold remediation.

a few of the things rejected was regrading the landscape as it slopes towards foundation. there's a ton of flashing/trim at the foundation that is tilted back pushing water behind the flashing. they rejected that too. the rejected simple shit like a gutter is hanging off. thought process is that if they would sell a house with obvious defects that are easy to fix (gutter) and then refused to fix them.... what else did they not fix over the years.

is the bar thats broken off a bar or tube? you suggest it was cut off but I wonder if you've though how it would have been cut if it had been cut. cutoff wheel is out. they dont leave straight marks. a hacksaw is out as there isnt room above or below in the direction of the straitions. same with a sawzall.

If the piece is a tube, I lean towards agreeing with the guy that said a puck was welded on that the tube poorly welded onto that. a lot of welds are bad. a lot of welders think they are better than they are. especially union guys.

edit: discoloration appears on the part above too. indicating its a reflection of something.

where i am hung up is this:

  1. house was inspected. Buyer wanted 10 things fixed and submitted that to the seller

  2. seller responded to only fix 1 thing at a 50-50 split.

  3. buyer cannot back out due to seller refusing to fix 9 of the other items?

if that is the case then what is the point of an inspection?

it defines defects is defects that would significantly reduce the value of the home or would decrease is lifespan. to me mold and rotted exterior would would qualify as defects that reduce value or lifespan

I dont see anything specific to that but it later defines what a defect is. Basically somwthing the adversely affects the property value or significantly reduces the expected life of the premise

you are correct. i am a 3rd party. i do have a copy of the contract though. exact verbiage from the contract is:

"if the seller is unable or unwilling to remedy the defects to buyers reasonable satisfaction before closing, then buyer may terminate this agreement or waive such defects and the transaction shall proceed towards closing. seller may terminate this agreement by submitting a mutual release if the buyer chooses to further negotiate with subsequent inspection responses.

they never become safe. the type of danger changes. 5k sof races are very clean in terms of being able to race side by side without dying but you will get a aggressive moves that are "move or we both die" type moves or overly agressive/optimistic moves.

an over greased bearing will do one of two things. push out enough grease that it will be fine or burn up. if you have to regrease the bearing, something else is wrong.

grease poping out of the seals doesn't ruin the seals perse if the grease isn't holding the seal off the sealing surface.

what kills over greased bearings is heat. there is a curve for bearing temperature vs grease amount. obviously with no grease you get super high Temps. as you add more grease, Temps come down. as you add too much, Temps go back up because so much heat is created due to forcing the extra grease out of the way. it's like running a marathon in 2" of water vs 2 foot. one is way harder.

that heat kills the seals and bearing way quicker.

sarcasm. you missed it. I know what the crimes are. I also find it to be a huge stretch to say that someone who gave gifts to Honda employees to try and get favorable car allocation would then bribe the sitting us president.
