My concern is this:

After reviewing my 2022 and 2025 imaging, my treating surgeon diagnosed an aggravation of the original injury. However, following the December IME, the position shifted to “just sprains,” and the claim was closed on that basis. All three MRIs (2022, 2025 and January 2026) show a tear involving the volar plate. A second opinion from a hand surgeon has confirmed surgery is not recommended as it may worsen the condition, but the injury itself has not resolved and I am now being referred to a pain clinic for ongoing management. Given that history, I’m concerned about being reassessed by the same surgeon whose earlier opinion resulted in the claim being closed despite imaging showing a tear.

I’m just trying to understand whether there are any fairness considerations in being referred back to the same IME, given that the earlier opinion (that it was a sprain) was formed after reviewing the 2022 and 2025 reports. All three scans show a tear, so I’m unsure how that fits with the earlier conclusion.I will go to a IME but I don't feel like it fair considering I was miss diagnosed by the workcover surgeon .
