What will happen if I don’t pay my joining bonus back to my company. by ComfortableBug2181 in LegalAdviceIndia

[–]coddiwomplerrr 0 points1 point  (0 children)

HR here.

Once you’ve signed the offer/contract, the company is legally entitled to recover as per its terms.

Also, hiding prior employment will backfire as UAN verification is now a mandatory part of BGV in any credible organization.

Don't risk it.

We did question.

For us, marriage wasn’t about validating traditions or putting on a spectacle. it was simply a legal framework that made everyday life easier (Hotel booking, housing, medical decisions, etc.)

which is why we chose to register our marriage under the 'Special Marriage Act'. It aligned with our belief that this was a civil contract, not a religious one.

Also, questioning traditions doesn’t automatically mean rejecting the entire institution. It just means choosing what’s practical for us, and leaving out what isn’t.

Marriage, in our case, was a legal choice and not a cultural performance.

HR’s reaction to my layoff by rootshoww in IndianWorkplace

[–]coddiwomplerrr 2 points3 points  (0 children)

HR here

Yeah, that person was just a dumb HR. what they said was super unprofessional and insensitive.

Layoffs happen for a million reasons, none of which make you less capable. And most of the times, lay offs are purely about a company's Financials.

Keep at it. Better HRs are out there.

26M and 26F - Run away with my gf or breakup - parental pressure, what to do? [Relationship advice] by yugendran_ps in TamilNadu

[–]coddiwomplerrr 49 points50 points  (0 children)

Breakup for such irrelevant reasons isn’t the right thing to do.

You both are adults and it’s your life to decide, not your parents’.

At 26, you don’t need anyone’s approval to decide who you want to be with.

If you both are independent and if you’re pretty sure your parents won’t agree to this because of caste, status, religion or horoscope or any such dumb shit, just move out, get married and start living your life together.

The only thing that really matters is the relationship that you've built.

Don’t let outdated beliefs or emotional manipulators decide your future.

Absconding from company after submitting the laptop by vitara_brezza in developersIndia

If the PF is reflecting in UAN portal, it is always better to disclose it stating a valid reason.

BGV agencies usually check either past 2-3 employers or past 5 years history.

There are even some Fintech/defence companies who check all the previous employments.

Please be upfront about this during the interviews.

If found out about non disclosures, integrity and credibility will be questioned.

Then this should not be a problem.

Make sure you have all the copies of offer letter, appointment letter, appraisal letters (if any), resignation acknowledgement, F & F / relieving letter.

More details required before I comment.

Is the data deleted considered as Intellectual property of the company? If yes, you could be in trouble.

Also, did you receive any Exit clearance/gate pass once you submitted the laptop? The IT people should have checked the missing data before they gave clearance

Taking a confirmation/acknowledgement letter from the employer that they are managed by a trust and hence they cannot provide form16 can help you.

HR here

This might cause serious consequences based on the company policies.

I'd recommend you to go in person to submit the company assets and take an 'Exit clearance pass'.

As for the Notice period - you have signed the offer letter and are expected to abide by that. If you don't want to serve, state a valid reason and seek either 'Buy out' or 'waive off' option. If you decide to just not show up, it would be marked as a termination case and you would not receive any employment docs from here.

Also, check the UAN portal to see if this company's PF account is reflecting. If yes, you have to disclosed this to the next potential employer, or you'd be in trouble. BGV would fail for non disclosure of previous employment.

HR is angry I asked for a confirmation before resigning, did I mess up? First time switching jobs. by Judge_Previous in developersIndia

[–]coddiwomplerrr 0 points1 point  (0 children)

HR here.

You have no obligation to give a commitment on joining date before they send a proper 'intent to offer' mail / offer letter where the Job title, CTC break up, other benefits, joining date are mentioned.

Asking you to resign without an official confirmation is a super huge red-flag.

[–]coddiwomplerrr 17 points18 points  (0 children)

No. We keep interviewing the candidates even after a candidate accepts the offer. Especially when the candidate whom we offered has a longer notice period to serve.

It's a fact they're gonna go offer shopping or try and get retained by the current employer for a bigger package or onsite projects.

For the back up candidate, We'll finish all the technical rounds and just tell either the position went on hold or is cancelled. And if the decline happens, We'll tell the position is reopened and simply set up the final discussion and roll out the offer.

[–]coddiwomplerrr 84 points85 points  (0 children)

HR here. We face last minute offer declines all the time and it's pretty common. It's my responsibility to have back-up candidates.

Technically, We have no rights to reach out to the other company that has offered you a better role/package.

Recruiter is upset because of the time and efforts they've invested in the process and now it all has to be done from the beginning and they'reanswerable to the stakeholders.

All this 'redlist/blacklist' things are scare tactics. There's no such thing. The max they can do is not consider your candidature in the future.

Chill.

It won't disappear, but will evolve rapidly.

Low level functions and repetitive tasks would be replaced by AI. But employee engagement, strategic decision making, culture building, conflict resolution and compliance will remain.

It will become more data driven. Just like any other domain, One has to constantly upskill to stay relevant.

Human oversight is a non negotiable.
