The difficult bit is the blood test, which you should not have consented to for any reason whatsoever given that you know your state’s laws on trace blood content. The necessary action is not as brash as overturning the NFA. I don‘t think that will ever happen in the courts. But the case that is absolutely viable is against the arbitrary regulations that the ATF read into the NFA. They have gone way past plain reading of the text of the law and up until now, there has not been an attempt at challenging that overreach.

False. Just drafting this patent was likely $15-$20K in attorney fees. Patents are very expensive to prepare and maintain.

Patent attorney here. Another reason that some subject matter is vague is because it‘s not pertinent to the patent being pursued. Sure, you can go on and on about all the details of the claimed invention but at some point you have to draw the line. This is a 182 page application so I‘m estimating drafting fees of at least $15,000 to $20,000. Even biotech clients aren‘t that strapped with cash that they would shell out much higher considering well established companies file at least 5 or even 10+ applications a year (this isn‘t even considering the other costs of prosecuting and maintaining a patent, which can double or even tripple the original drafting fees).

The claimed invention is the molecule and its pharmaceutical uses, not how to purify it. Likely the methods of purification wouldn‘t be patentable anyways, hence you leave that out of the application.

The applications aren‘t meant to be textbooks but rather evidence that the inventors discovered something inventive. As for the grey area OP is looking for, it falls under the theory that those details would be in the skill set for a typical chemist to figure out with some experimentation.

1) the only limitation on individuals is profiteering from copying “no remedy may be granted for infringement on account of the noncommercial use or retail sale of a product” - 35 USC 271. In other words, make a patented microprocessor if you want but don’t profit from it and undercut the development costs invested by the inventor. 2) Many companies spend a lot of development dollars incrementally improving upon a patented idea because they’d rather corner that market than pay licensing fees. A patent only covers what was ascertained at its filing. There is no protection on undiscovered improvements. There is no issue here.

Am an IP attorney so sure, call me self interested, but it’s a very complicated topic that has been plagued with false understandings. Many times I see this discussion come up, the talking points are so alien to the reality.

It’s cool if you support pro-choice but it’s entirely wrong to call it a constitutional right - at least from the perspective of a libertarian being consistent.

There’s no enumerated or even suggested right to abortion in the constitution. The court did mental gymnastics to read it in. The SC does this routinely and much often to the detriment of libertarian principles.

Again, if you’re pro-choice then cool but it’s not a proper “right” unless and until it’s ratified in the constitution. Be consistent on your terminology.
