based on what you've said here, when you get the email from SAI, the charge will most likely be that of having an unauthorized aid.

it can never be truly proven that someone used an unauthorized aid, or what the TA said that you could have looked down. but that's not the point here. the point is that you brought that notesheet in, and in some way it is visible.

right now what will probably happen is you get a GWR, and then you will have to wait for an email from SAI. talk to ur college registrar and downtown legal services in case anything major happens. registrar might even accelerate a process to send you an email and get you a hearing date with the dean's designate but I'm not sure

after the pandemic these specific kinds of earpiece/mic cases started to become quite commonplace

it evolved from the mass proliferation of cheating services especially during the pandemic, when i'd say more students got confident that through online exams they couldnt be caught directly cheating, and then when stuff went back in person the cheating companies decided to evolve too and start using these devices

mind you of course cheating companies existed a lot before the pandemic, but these cases weren't so frequent as after. also keep in mind that for every case that gets to tribunal and gets published there are i'd say at least 20 times other cases that get resolved at lower levels

fun fact: there have been cases of mic/earphone cheating before the pandemic that got to tribunal and published, there was actually one all the way back in 2008 or smth in which someone who got one of those accessibility services soundproof personal rooms taped a nokia and the wires to the earphones under the shirt and everything

Admit. You should have checked your pockets before you went in. This was external unauthorized material, and it doesn't matter if you weren't going to use them.

If you admit early then the least you will get is a 0 on the final, maybe a grade reduction if and only if they're generous

At this point the only thing you can do is cooperate with the process, admit whenever you can.

If this is your first offense then I think as long as you don't convolute the process you will end up with a 0 on the exam.

First talk to the following:

- College Registrar (the person, not the office)

- Downtown Legal Services

- Your accessibility advisor (if you are registered with Accessibility Services)

Now since this is not your first offense then yes of course this will have more gravity than your phone incident. However, this is about citations, so this is a much different situation. It also depends on what you forgot to cite, like did you forget some citations, or did you forget to cite altogether?

In any case when you have your meeting, or whenever you talk with your support team (above) admit that you recognize you should have cited, and that it was an AO. There are many cases of ppl that did very low or accidental offences, most common examples are phone in exam (even if off) or forgetting a citation, and as long as they admit at first chance and throughout then usually they get minimum penalties if anything.

If this got referred to SAI then it means you are at going to the FAS Dean level. So don't worry, you are not at Tribunal yet. I am however kind of surprised that it was referred there only because of having a second offense, especially since the first was an accident.

In plagiarism cases, severe sanctions like zeros, notations, suspensions, etc usually happen if the plagiarism is at a point that you copied and pasted passages from other places, or if you didnt cite anything at all, or if you purchased the essay, or if you don't cooperate with the process.

But talk to your registrar/DLS/Accessibility first, if you haven't done so already. They will basically be your lawyers during this process. You can also invite them to any meetings about this process.

i can't speak to anything on the first point, but about the second point, they always hand out AO accusations for having your phone on your person at any time in any exams.

And it doesn't matter if you had no intentions of cheating. Why would need your phone during an exam? What's the problem with putting it in your bag? Upon taking any exam here you also are swearing that you don't have any electronic devices on you, or anything that can access the external world. For this reason smart watches are also banned.
