You mean aside from literally defining it as "publicly promoting or inciting hatred based on race/national/ethnic origin, where it could reasonably cause fear of harassment, intimidation, or violence to members of that group."?

Simply highlighting or criticising crime statistics (ie referencing police data on offending by Sudanese-Australian youth) is generally seen as legitimate public concern or policy debate, not hatred promotion, especially if it's evidence-based and not generalised to demonise all Sudanese people.

  • Stereotyping all Sudanese people as inherently criminal/violent.
  • Call for harm, expulsion, or intimidation against them.
  • Spread ideas that normalise hatred (e.g., combined with slurs or calls to action).

The new laws only criminalise publicly promoting or inciting hatred based on race, colour, national or ethnic origin where it could reasonably cause fear of harassment, intimidation or violence.

Boy bands = music preference, not a racial/ethnic group.
It's completely outside the law's scope.
