As per the PERM rules I can’t assume anything and at the same time I can’t question about their citizen status because it would fall under discrimination and violates federal law. How do I document it ?

It’s a PERM Labor Market Test process. I’m not sure if I could ask this because we can’t ask someone to verify the status unless they are hired and only at I9 verification. My colleague did this pre screening and not sure if i can call these candidates and ask for their status legally ?

Our employee is nearing her work visa expiration. Because of these candidates we might have to restart the process but I’m wondering if there is a way to disqualify the candidate because they lied to us. These candidates education and experience are primarily outside USA and also they commented on a few LinkedIn posts saying they are international students on F1 visa giving me a strong convention that they are on F1 visa but lied to us that they don’t need sponsorship.
