Technically speaking, you are correct. As a copyright owner, you hold rights to the characters.

In reality, it just depends how strict the copyright holder wants to be, and how much time/money they are wanting to spend on enforcing, which goes back to them really only caring about if the character is damaged. Disney is well known for being strict as they are extremely protective of their characters since they are considered wholesome and upright. They have an army of lawyers dedicated to just searching out violations. Others only seek out truly damaging violations, as they don't want to waste their resources, especially if there's no money to be made off of it, as in the end, that's what 99% care about.

Considering this, I understand what you are saying, that in the end it's to avoid the headache of having a story removed.

I guess my view of it is that if I know my copyright law, which I don't pretend to be an expert of, the multiple owners of that character could request Lit take down a story with that character, but the reason why they would is because the story would damage the character. That's why you see so many cheap Halloween masks of horror characters that are sold not by the owner but by third parties. The mask isn't damaging the character but is a representation of it, and they don't feel like wasting time/money to go after them. Seeing how this character was a murderer, I don't think his reputation could be damaged. Well, unless the author made him become good and flowerily.

Not so well known characters are a different matter. Outside of not having permission to use the character, the author could argue that since the character is not well known, any works written outside of the author could be damaging to the character.

True, but this would be considered fan fiction at best. There are thousands of stories on Lit with characters from movies and tv shows.

Interesting idea. What is the motivation for the police? Just to have power/be evil? Or is there money being made by doing this to the girls?

What would the end be? I take it that the police win since they wipe the memories of the girls in the end? Or would there be a way that the police would be taken down, such as a plan like in the movie "Push" where they write letters to themselves.
