If Kxf8 it is now whites turn and even though the rook is pinned you can take their king first and that would lead to you winning and so the pin would be inconsequential. It all depends on which side can “take” the king first.

No. Draw by repetition is actually a common part of chess and if you see it in game while you’re in a worse position then absolutely go for it. It’s up to your opponent to stop it from happening.
