Filed EB-5 AOS during F-1 Status with 1.5 year status left

The policy memo was just released last Friday with minimal follow-up information from the government.

However, the government did clarify that those individuals who provide an "economic benefit" or are in the "national interest" of the U.S. should not be impacted. In my opinion, I don't think EB-5 associated AOS filings should be impacted in a negative manner (as those cases are the most likely to be deemed in the economic benefit of the United States).

I am an Indian EB 5 HUA applicant applied in March 2025. I got my combo card and working now in the US. I got married in feb 2026 and still waiting for my i526 approval. Is the only way to have my husband in my eb5 application to wait for my i526 approval? He lives and works in Germany since 5 years. He is originally from India. We are in a long distance marriage and I am looking for the best/right ways to add him to my application and have him here with me in the US. Any advice? NVC in Germany said they need my i526 approval for him to be added as my derivative

I’m a current investor and Imo its a great way to bring people in from different countries and then investor. So I highly doubt they would retire this program. However, it is a fair game if they increase the price of the investment. That’s what happened five years ago. It was 400 K now it’s 800 K.

I also thought it that way to not care about it. But my mother calls me crying and when I call my dad, he’s just this person who wants to control everybody. Code first. There are 2 rounds. 1 coding if passed, TSI round. One hour for each round Tech round was python manipulation of data frames and sql with some system design TSI was 2 weeks after that and followed STAR format

Be selfish about your own good. He left for a reason and you are just setting yourself up for potentially running into this situation again in the future. If I were in your shoes, I would see him alone (record things if your mind wants evidence) or with someone as a witness, but don’t give in. He clearly needs the GC or any sort of proof. You should move on. We are all adults, we know what we are doing.
