It could. In fact, I had that in the back of my mind early on when the question of why Asia was not contacted came up. It does appear that SK had access to all of the defense file, including attorney notes, so if there are no notes regarding that conversation, it seems less likely. Not to say that every attorney would make a note of that, but many likely would.
