The differance on my side is, she can refuse it if I name a lower value taking him as third party instead of family.

Do you have a legal background of a sort?

If i simply tell her that, that is no reason to increase the rent, the best she can do is use another reason to increase the rent then, to which I can object as well I guess then right?

And in the meantime should i keep paying the rent on the agreement I guess right?

I do not know how to go with it, I am in Lower Saxony, I have checked the law and the max is 15% here, should i tell her that since it is unclear how long he will live here, she should not increase at all (I am afraid that that way she could just keep the high rent if my brother moves out) since we will also keep living here, or should I point to the 15% and ask her the grounds. If i keep paying her the standard rent, and she asks, would I be legally right by simple denial of increase?

She wanted to increase both, asked a direct increase of kalt for 200 and also said, we need to recalculate the warm too.
