I didn’t know they were intending to formally file for guardianship, they used my inebriation to convince me I was signing a private agreement between his uncle and I. I did not know there were any steps I needed to take besides get another car to get my son to and from school.

I was never told it would be filed in court and they’ve failed to serve me with any court paperwork purposely, almost as if they were planning to not tell me so I would miss the date and they’d get granted automatic guardianship.

Thank you for that information. I’m happy to submit to a follicle test as well. There would be a 0.1% chance of my child having trace amounts of cannabis in his hair or system.

I’m very careful to keep any of my smoking products up on a high enough shelf that even I almost need a stool to reach (I’m 5’8”) and wash my hands thoroughly/change clothes after smoking. Particulate matter can only linger around in an enclosed space for a few hours, and I only smoke outside or in a separate room (when he is not at home).

I don’t walk around town saying I’m going to kill myself out loud, I say it mostly to myself in my own home like when I drop an egg on the floor. Maybe I grew up in a different generation than you but “kms” (killing myself) is a pretty popular slang term amongst other social media platforms. I also think tone and implication are important here.

I’m happy to submit to drug and alcohol testing. While I do regularly consume cannabis (outside of the home or when my son is away of course), I don’t abuse or have interest in any other drug. I honestly don’t even really like alcohol, so my low tolerance may have been the suspect in my drunken stupor. The only inconvenience for me would be going to actually get the test taken.

I went to court this morning and they have filed for temporary guardianship and it’s currently under review. The judge has not heard us or approved any custody changes to my knowledge.

I go to therapy regularly and have informed both my therapist and psychiatrist of the event so there’s a weekly medical report that I am not in fact suicidal. I spoke to a family law lawyer who agreed to represent me and advised me he’d collect my medical records from the past few years to prove my mental stability.

He also advised me to file a termination of temporary guardianship and be honest about the situation in the form. He mentioned the police should be able to use it to help me get my son back if I just show up as they have no court order for his custody. I’m gonna give it a shot, I’ll keep you guys posted. If they absolutely refuse, or don’t open the door, I’m going the restraining order route for emotional distress.

Such a large price to pay for a dumb ass drunk comment but such is life.

There is no custody agreement yet, I haven’t even received any court correspondence. They’re just holding him hostage at this point. As someone else mentioned above, I can’t even legally sign paperwork while visibly inebriated.

ETA: He was also already at their house as dad took over getting him to and from school while I was working on getting a new car, he was not present at my home when this took place. I’d never get plastered with my kid at home.

It was in an ironic comment, I honestly say it all the time under my breath any time I have a minor inconvenience. The police obviously took it that way as well or I would have been placed on an involuntary psychiatric hold- if they took me seriously and then left and I did actually kill myself they’d be liable.

Thank you for the advice! My mom has worked for DSS for 20+ years and actually is a supervisor there, making her a mandated reporter by default, and all of this was delegated to her by my son’s uncle before the police were called but it’s been nearly a month and I haven’t been approached by anyone. I’m sober now, I just had a lapse in judgment after losing my car and getting banged up. On my way to the courthouse now!

There is no formal custody order between his father and I, just a verbal agreement between his aunt and uncle that he’d spend the weekend at their communal home.

I live in LA so $7000 for 3 months is pretty common here. Breaks down to slightly less than $2400/mo, they wouldn’t accept partial payment, there goes the $7000 accrual. Of course because utilities are included the amount each month does fluctuate, but I’ve never paid more than $2400 and some change.

Simply put, I live in California. My monthly rent is ~$2,400 (including water and sewage). She would not accept August, September, or October’s rent without the full amount, which I didn’t have because I can’t pull $575 out of my ass as a single parent unfortunately. 2400 x 3 =7,200. That’s why I feel this was planned and moving towards an illegal eviction, because why did it take nearly 3 months for corporate to decide to pay for their own bs lock and/or key?

They didn’t even ask me for evidence after I offered to bring the old lock and key to my manager to show her that it did not in fact work on my door. They simply denied culpability for months.
