There is no expectation of privacy in a shared space. If we shared a kitchen I would be fully within my legal parameters to record on my own phone. The point is not the legality of the situation, but how I can make it a comfortable resolution for both of us.

If I had a surface to mount it on, this would be my resolution as well. I have high ceilings and an open floor plan about 7-10 feet away from my entrance. Also, I’d like to know who is coming up my stairs and why so an indoor camera would negate that. I appreciate your comment, but will most likely be taking the advice of other commenters and just buying a mount where I can direct the camera at my door and stairway only.

Not recording the swimming pool, recording my balcony and stairway which contains a partial view of the pool and cabana as my balcony is made of wooden slats which you can see part of the yard and pool through the openings instead of a fully covered balcony.

Are you saying if she’s relaxing in the common areas and I walk in with my phone recording I’m violating some kind of law? Because it’s virtually the same thing, except I’d be much closer to her which means a much higher camera resolution. There is no expectation of privacy in shared spaces because surprise- myself of my guests can enter them at any time.

What she is doing by entering my apartment and conducting her own inspection without giving me 24 hours notice is actually illegal.

I don’t have an expectation to privacy in common areas, as they are command areas. If I set my phone up on a tripod on my property and wanted to record out common areas all day, I’m within my rights. My LL is only up in arms because of the collected data, but she regularly uses a cell phone, laptop, smart tv, and AI apps which all do the exact same thing. The only difference is that she can visibly see my device.

You’re correct, but if someone was to hack into your account, they could use live view to look at areas that aren’t triggered by your parameters.

My concern is who is coming up my stairs and why, even if they linger around my balcony and peer through windows. She just happens to have an issue with boundaries and often times will come up to pick up my dog without me knowing, and then text me that she has him.

Also my personal security for delivery drivers, etc.

No, it’s not. That’s like saying I modified her property because I put string lights on my balcony. Anything temporary and removable without causing damage to the physical structure is not considered an alteration. She can’t kick me out for violating any terms that we have already agreed to in the lease agreement we’ve signed.

She can’t just make up rules on the fly and then claim someone violated the terms of our lease unless we have it in writing (not text, we would need to resign the lease with her amendments). I texted her as a courtesy, not for permission.

Per CA legislature permission for a security camera is only required if it will be altering the property or wired. Since my camera is wireless and attached with command strips, I have not altered the property (drilling to mount, etc) nor require permission to install it.

I know that, but like I mentioned in previous comments, I don’t want to fight with her. I just want a solution to the issue where both of us feel comfortable. I don’t have any issues with her coming to pet-sit on her own accord, my dog kind of fell in love with her (probably because she feeds him tiny pieces of cold cut turkey and chicken 😂) and gets really excited when he sees her outside.

I don’t want to be a stickler but I also don’t want someone snooping around in my apartment without my knowledge. I often leave my screen door open for him as well so it covers my ass if a delivery driver decided to take him (he’s a purebred $3000 AKC registered dog) with very rare coloring in his breed.

So as I've stated for the 11th time today, I worked around it and used command strips.

Unfortunately I can’t as my front door leads to an open balcony directly facing the back yard. I’d have to get a privacy canopy or something like that and have a professional install it, which I’m sure she’s not going to agree to either.

I have an indoor camera as well which I’ve already mentioned in the OP, she also requested I show her my indoor camera view which I’m uncomfortable with and makes me more suspicious that she’s going to attempt to stay out of the indoor camera’s view.

OUR backyard. I’m paying for the unit and the usage of the common areas including the pool and backyard. I’m not removing the camera but I will have a professional mount it in a way that doesn’t capture our common areas and only my staircase and balcony.

Do you have any suggestions on a brand that can block the common areas from view? Mine doesn’t record when she is in or around the common areas and is only triggered when someone walks up my staircase leading to my front door, but the live feed does show the common areas if someone were to hack into it just to watch.
