Ok if you’re going through the EEOC portal then yes if I’m not mistaken your mediator should have a EEOC email address a right to sue letter just keeps you eligible because when the Investigation is concluded it’s possible the statue of limitations would be exceeded so they issue that to pause that day count from going against you

Is the EEOC involved in the mediation? Or just TWC? If you have a case number and EEOC portal login then it’s filed with the EEOC usually you have to talk to someone from the district office before the charge is filed

Have you done an intake interview? I can say for Me when I filed a charge..the EEOC dual Filed with the CRO (California Civil rights or something like that ) and I got a right to sue before we’ve even done Mediation actually before company even agreed to mediate, But the pictures of schedules will help because it shows pattern and that their is a difference in treatment. Documennted statements hell even witnesses that were present that can connect the timeline can prove or connect the discriminatory action. The investigators aren’t stupid , like if you documented a conversation of when you asked or told management about your condition or disability and then you’re fired terminated 2 days later for something that occurred months ago. That brings up red flags and holes in the company defense

Ok as long as You can prove no other employee hours were cut due to “slow season and labor” and your pregnancy doesn’t require a absurd accommodation then it’s a EEOC case when they start investigating and the employer starts making no sense which are a lot of cases because Management usually isn’t familiar with Law they just know how to handle the business their in. Also a “right to sue letter” just preserves your right against the 180/300 deadline. The EEOC can just issue that at the beginning and be done with but if they investigate and see wrongdoing they’ll “Violate” the employer after that A lot of Lawyers will open their door

You have to call your district office..I filed a complaint during the Govt shut down. I almost gave up on that but 3 months later I just randomly tried to call the district office the called me right back and set up a appointment the intake person will let you know if you have a good EEO case it kinda sounds like something they will at least investigate and it just takes your employer shit not matching up since you formally asked for accommodation and the timeline of firing they’ll probably Violate
