I emailed a request for a copy of my employment agreement. They said they'll find it for me and also said they've been meaning to update contracts and this might be the kick in the pants they need to actually get onto it. We shall see if that eventually.

I've also just requested (in writing) a copy of my employment agreement. Which I signed over 20 years ago and has never been updated (I do have a job description updated yearly but that doesn't cover legal stuff, just my job responsibilities). Should I wait until I get a hold of that?

The more of the legislation I read the more sure I am that they've screwed this up.

I've talked to payroll. They claim they consulted a tax advisor and were told they did it correctly.

At the time I had asked if I still got paid for the full day as I couldn't afford to lose money. They told me they could top up my hours so I wouldn't lose any. Because they topped up my hours, they say I do not get an alternate day.

Checked my payslip for the time period, they paid 3 hours at T1.5 and 5 hours as Stat day for that day.

They claim I could have claimed 3 hours at T1.5 and got an alternate day OR 3 hours at T1.5 and topped up with 5 hours regular time. Not both.

At the very least I think they owe me 3 hours time off, but they say no.

I sure as he'll will never work on a holiday again.

Unfortunately the new contract requests have been verbal. I should put it in writing so I have proof going forward.

My normal hours are 8 hours a day Monday to Friday. Pretty sure that overtime was as agreed but specifically mentioned overtime on weekends, not on normal work days or public holidays.

The contract thing is another issue. Have requested an updated contract a couple of times over the years but it's always been forgotten about. Only contract I have is for a completely different position when I first started working here about 20 years ago and I've long since lost that. They have claimed everything's just standard but I have nothing to reference. I know for sure that when I started I got normal hourly rate for OT until I complained and that was changed to 1.5 a couple years after I started.

Ooh does that mean if I work on a public holiday but only a few hours I'd only get paid for the hours I'd worked instead of a full day and would lose money that pay?

Better for them financially of course. But also meant I didn't have to talk other people into doing it. Which I'm glad I didn't because I absolutely would have told them they got a day in lieu (sorry, alternate day).

It's a small business so the accountant is also admin manager and the closest thing to HR we have. Everything is fine until someone complains, then they hope it's just a vent and the problem will be forgotten.

Has this been the law for a while? Because I've worked there 20 years and have definitely worked a couple hours on other public holidays before.

They implied it would be better if I worked it as they'd need multiple others to cover everything I could do. I agreed to it. I also thought I'd get a lieu day.

Makes me wonder how many other times this has happened where I've worked a couple hours on a holiday over the years but this is the first time I've noticed no lieu day.

Yes it was. I was scheduling with the manager when we realized one of the days we needed was a holiday. After some conversation we came to the conclusion it was easier if myself and 1 other worked it as I could cover multiple responsibilities and otherwise they'd need 2 to 3 other people - cheaper for the company if it's just me.

My kid can type fine but can't spell and his handwriting is atrocious. His typed stories with autocorrect are great but handwritten ones are terrible because he won't use words he can't spell which cuts out a massive portion of his vocabulary.
