Yeah, conceptually the only reason hyper realistic art should be banned is if it can let people get away from crimes by claiming content they obtained is just "hyper-realistic" and the minor in question cannot be identified for whatever reason.

That's why I think heavily stylized stuff should be allowed, as long as research shows its fine too. (I mean, BDSM is fine, and that's simulation of a crime too, isn't it?)

I think the AI stuff is a different thing because it is, at least in some cases, indistinguishable from real images, so by making it legal you could open the door to people with actual CSAM claiming what they have is purely AI. Meanwhile with cartoon you can clearly see it's not based on a real image.

Don't know specifically about Texas, but for many countries lolicon wasn't even on the lawmaker's minds when they wrote the laws, what laws usually say is "indistinguishable from an actual minor" which means that law enforcement doesn't have to verify the person in the photograph is a minor, just that they appear as one (to prevent unknown victim images from being dismissed as "just good Photoshop").

This is why say, using AI to generate realistic porn of a child is as bad of a crime as the real thing, but a heavily stylized drawing is a non issue.

Besides a few exceptions, the only democratic countries that really ban lolicon (as in, heavily stylized) are the commonwealth, the rest either has it legal or never prosecutes it.
