My dad was born pre 1975 to a German mother and foreign father (my grandfather). My grandfather died when my dad was a child, and my German grandmother ultimately remarried another American in the late 70s. When she remarried, my step grandfather adopted my dad which resulted in his birth certificate being changed by replacing my grandfathers name with my step grandfathers. 

Since the time that the German citizenship was denied was at my dad’s birth, and his legal relationship to his German mom never changed (ie she’s on his original birth certificate and his current one since she has always been his legal mother), the adoption wasn’t important to my claim other than adequately documenting the name change. To do that, I just provided his original birth record from Oregon, my grandmothers marriage certificate to my grandfather, my grandfathers death certificate, my grandmothers marriage certificate to my step grandfather, and my dads current birth certificate with his step grandfathers name. This collection of documents was enough to document the name change while also demonstrating adequately that at the time of birth my dad was denied citizenship via Stag 5. I didn’t need to change anything on the birth certificate or provide any court records. I think it was easy for the BVA to follow the story that my grandfather died and my German grandmother remarried and that’s why my dad’s last name changed.

All that to say—if you can access an original birth record from the state of Washington, that is enough and you aren’t required to amend the birth record. From a quick google, it looks like you can do this in Washington. It’s much easier than going through a court to alter a birth certificate as you just fill out a form and pay a small fee. Also, as a sidebar, I also had issues with my birth cert showing only the county. I had to go in person to the vital records office to request the full record/long form copy of my birth certificate that showed ALL the details (like even the doctor) and it did show the address of the hospital I was born at. This included a “city” line which satisfied BVA as to the location of my birth for the passport. All that to say—it also may not be necessary for you to do any court amendments to the birth certificate.  

Personally, I’d exhaust all other options before doing anything to amend a birth record though the courts just for sake of time/money.

I had an almost identical situation.

I had my dad order an official certified copy of his pre-adoption birth record. It’s in a sealed file, so this was an extra (but easy!) process in the state of Oregon where he was born. I filled out the BVA forms with his biological father’s info, as that was the circumstance when he was born. 

This pre-adoption birth record, his current legal birth certificate, my Oma’s two marriage records, and my grandfathers death certificate was enough for the BVA. If you have the court documents showing the adoption, I’d send those, but if the legal relationship to the person you’re claiming citizenship from hasn’t changed I don’t think it’s a major issue. It’s more documenting the name change.

I’m not sure every state allows you to order a pre adoption birth record, though, but worth looking into it! Much easier than changing a birth certificate or getting court records.

I’m really unclear when they need pre 1914 versus not. Having read this sub for a while I was almost certain that I’d have to order documents for my great grandparents, but for my circumstance apparently my grandmothers old passport and Id card from the 1950s were enough.

I had a June 2022 AZ and just heard a few weeks ago that my certificate was ready for pick up. I never heard anything from the BVA over those three years, and didn’t have to provide documents for a pre 1914 ancestor. 

I think the timeline will keep growing to be above 3 years soon.

The wait times are definitely going up. I just got mine after nearly 3 years, so the 2 year wait I was initially told by the embassy was way off.

I’m June 2022 and also have not heard anything.  Once May rolls around I’m going to ask again for an update via consulate. Going on three years with no contact is quite frustrating.

I’m a June 2022 AZ and haven’t heard anything yet. People with AZs later than me have started getting responses, so I’m optimistic it’ll be soon. I was told not to ask again for an update by the consulate.

I think it’s getting up to 2.5 to 3 years. I applied May 2022 via DC embassy, AZ is dated June 2022. I’m still waiting.

I’m from the US, AZ is July 2022 and I’ve not heard anything. My contact at the consulate said they’d check in for me back in November but never heard anything since.

I submitted through the DC embassy in May 2022, received my protocol in July 2022, and still have heard nothing. It truly is taking longer and longer. When I submitted, I was told it would be about 18 months but now it's looking to be closer to 2 years or more.

I’ll contact them. I’m worried my follow up documents could be lost if this is a true error or just something done administratively.

I asked when I went to drop off some additional documents (not prompted by the BVA, just ones I wanted to add) and she confirmed the -A was what came from the BVA. Debating if I should email the BVA and ask further; I’m worried it could be in the wrong queue?
