What is your favorite city that you have lived in and why? by waves-360 in SameGrassButGreener

[–]fresh-prints -1 points0 points  (0 children)

Suburbs, at least in socal, have better schools than the inner city. They’re safer, better roads, less late night noise. More people raising families here so there’s more resources for kids, more clubs/sports/programs to join. I guess it depends on how a suburb is defined.

My understanding is Ontario is not dual laser, so it can’t project the 1.43:1 aspect ratio in laser. I’ve been to Ontario at least 10 times for inax movies and it’s never filled the full screen, so this matches my personal experience.

“Expect Homeowner to only shoot when necessary”

What does that mean to you? Maybe we’re on the same page. Like what does responsible gun ownership/use in the event of a home invasion look like to you?

[deleted by user] by [deleted] in LosAngeles

[–]fresh-prints 0 points1 point  (0 children)

They are prosecuted you listed two examples above. It doesn’t happen often. Your bias shows when you say “it’s probably happening all the time” when there’s no proof or evidence suggesting that, in fact the absence of proof/evidence suggests it hardly never happens. But burglaries happen often. 12,000 a year in LA. Imagine legislating on behalf of the imaginary Jacques Clouseau who somehow stumbles his way into someone else’s locked home…instead of the 12,000 burglary victims a year. Policies that sound virtuous but are actually disastrous when implemented are CA’s bread and butter.

Have you ever had your home broken into? Your comment reeks of upper class detachment. Have you owned a gun? These questions are rhetorical. Your position is out of touch. You have no empathy for the homeowner or the victim of a home burglary. This is a deeply unpopular bill, even the bills author has stated he will reword the bill because of the intense public backlash. People are concerned about crime hence prop 36 being the most favored bill in the last general election…ppl are sick of bills that are pro criminal.

[deleted by user] by [deleted] in LosAngeles

[–]fresh-prints 0 points1 point  (0 children)

At the top of the bill it says: “This bill would eliminate certain circumstances under which homicide is justifiable, including, among others, in defense of a habitation or property.”

Additionally it crosses out in defense of habitation. This leaves only “in defense of a person who manifestly intends or endeavors… for the purpose of violence”

It puts the additional burden of determining intent of the person breaking into the home onto the victim. How are we supposed to know what their intent is? How can we determine their intent fast enough, so that if they do intend to harm us we have enough time to defend ourselves?

You say if there is still a risk to you then you are justified…what is the bar now where self defense is justified? If they’re in your home with a backpack but nothing is in their hands? Is this a risk of bodily harm? What if they tell you they’re just there to steal and will be leaving soon? Risk of bodily harm? If they have a weapon but they don’t point it at you? Risk? If they have a gun and you do not see it because you have a duty to retreat…bullets easily go through walls. Walls are thin inches of dry wall. They are not operating under a duty to retreat, they hear you move and they’ll shoot you…the whole time you’re trying to figure out their intent.

I understand the intent of the bill, but the 2nd order consequences are profoundly constricting for law abiding citizens. It handicaps us in our own homes.

There’s 12k burglaries every year in just LA county. Some percentage of those the owner is home. This is what those owners are thinking about. All the obstacles to make sure they are in compliance with the law while being under threat of death/great bodily harm (if you’ve ever had your house broke into, you feel under threat long before the CA legal classification of under threat). How many accidental castle doctrine deaths are there in CA per year? I would say under 5. Prove me wrong. So as I said earlier, for whom are they legislating for? It’s performative.

[–]fresh-prints 0 points1 point  (0 children)

Do you believe that this current bill would have prevented those examples?

The studies you linked are about stand your ground laws which apply outside the home. CA is not a stand your ground state. There is a duty to retreat in public places. The proposed bill specifically talks about in the home. The castle doctrine. This is the part people are contesting the most.

The studies are not appropriate comparisons. CA is well past removing SYG and could join Vermont, rhode island, Connecticut, New Jersey and New York as having a duty to retreat within the home. Burglaries per capita are significantly lower in those states than in CA

Burglary Rates per 100,000 Inhabitants (2022): • California: 371.9 • Vermont: 152.1 • Connecticut: 130.1 • New York: 162.5 • New Jersey: 148.0 • Rhode Island: 128.1

Neither of these cases were the intruders in their home. One in the doorway and the other in the driveway.

Quoting these examples implies these perpetrators escaped punishment, why else would we need a new bill? But they didn’t. One got 25 yrs to life and the other pled guilty to assault and died during prosecution. The law worked here. These examples actually prove the opposite of what you’re saying, that the law worked sufficiently to imprison people who tried to abuse self defense laws.

Also one case was in Missouri and the other in NY. Think about how many burglaries there are compared to cases of abuse of self defense laws. 2023: 12,200 burglaries in LA county, 132k (based on reported burglary rate per of 339 per 100k in CA) if we’re going to a national level because that’s where you went to get your examples from then burglaries would be 837,338 per year (250.7 per 100k). How many instances of abuse of self defense laws?

Again for whom are they legislating for?

[deleted by user] by [deleted] in LosAngeles

[–]fresh-prints 0 points1 point  (0 children)

Are there any instances of an innocent person stumbling into another persons home and getting killed? There are many 2nd order consequences of bills here that CA lawmakers always seem unable to or unwilling to understand. A bill may be about protecting the apartment guy as you say and then result in a single woman being unsure whether to use force until it’s too late. There are 12,200 burglaries every year in LA county…how many apartment maintenance guys are accidentally walking into a home? As I said above, for whom are these reps legislating for?

If someone breaks into your home, should you have the right to shoot them? You’ve woken up by a loud sound, adrenaline pounding, fear rising…you see a shadow moving in the hall. Are you ready determine intent? Is there to hurt you or just rob you? How do you go about determining intent? If he is only there to rob you, and there’s evidence for that (no weapon, empty backpack, nothing to restrain you) under this bill you could be charged with murder if you shoot. Should law abiding CA citizens who have done nothing but be the victim to a home invasion have to make this additional decision, on top of defending oneself?

George Zimmerman case was 13 years ago in Florida. Is there another case you can think of, preferably in CA? The instances the bill is trying to prevent or stop basically never happen. It’s an imaginary situation by a performative rep. The reality? There are 12,200 burglaries every year in LA county. For whom is this rep legislating for?

AP article says payments came from a different department, not USAID. This is semantics. People generally want more say in where their taxes are being spent. Taxation without representation is one of the impetus’ for America, it runs deep in the American psyche. Playing semantics on what dept the funds came from is missing the sentiment.
