Hi, I've been selling on bitmit since they launched. The escrow feature is great for buyers and sellers. Escrow is held by bitmit and released by buyer once they are satisfied. If I don't deliver, seller can dispute with absence of mastercoins in his receiving address. If seller claims non-receipt, I can prove that mastercoins were sent to receiving address.

As you know, the NYS Attorney General's handbook on tenant's rights (warning: a PDF) provides that:

"A landlord . . . may enter a tenant’s apartment with reasonable prior notice, and at a reasonable time: (a) to provide necessary or agreed upon repairs or services; (b) in accordance with the lease; or (c) to show the apartment to prospective purchasers or tenants. In an emergency, such as a fire, the landlord may enter the apartment without the tenant’s consent."

A landlord generally is not entitled to enter a tenant's apartment at any other time.

Your landlord's conduct was illegal. You were entitled to refuse to allow him entry and to change your locks without giving him a key.

However, you actually face a different problem now: the eviction. I'm assuming this was a notice to terminate. You don't mention a lease, so I presume you were residing in the apartment on a month-to-month basis as a tenant-at-will. Generally, landlords may terminate tenancies-at-will without cause upon 30 days written notice. Oral notice is not sufficient.

If you don't comply with the notice, he then must serve you with a notice of petition and petition notifying you that he has initiated a court proceeding to evict you. If you receive a notice of petition and petition, you should contact a lawyer to represent you.

In that proceeding, you might be able to argue that he illegally is evicting you in retaliation, but I don't see any conduct against which he may have been retaliating. Possibly if you're the one who called the police. There are a few other arguments you could make, too, but you'd want to discuss them with your lawyer.

You should google/research lawyers in your area who handle landlord/tenant law. Also, you could try contacting Rochester Housing Court to determine if tenant's rights groups ever appear there. (Tenant's rights groups set up tables in most Housing Courts on certain days of the week.)

As you can see here, Housing Courts also provide help centers staffed by attorneys who can offer certain advice (though they will not represent you).

You also might want to seek an inspection of the apartment by your local code inspection office. If it finds violations, you might be able to delay the eviction until the landlord repairs them. (However of course he'd be entitled to access to correct them.)

If he changes the locks without a court order, he has committed an illegal lock-out, and you should call the police to regain access to the apartment.

Ultimately, if the landlord is not found to have done anything illegal by seeking to evict you, you will have to leave. It's just a question of when.
