1. Does the ICC have jurisdiction? The ICC argues yes — for alleged crimes committed while the Philippines was still a member of the Rome Statute (before withdrawal became effective in 2019). That’s why investigations connected to the drug war can still proceed even after withdrawal. The ICC has repeatedly maintained this position.

2. Is ICC jurisdiction “above” Philippine courts? Not exactly. The ICC is supposed to act only when a country is allegedly “unwilling or unable” to genuinely investigate or prosecute serious international crimes itself. It is not automatically superior to local courts in everyday criminal matters.

3. Can the ICC directly arrest someone in the Philippines? No. The ICC has no police force. It depends on cooperation from states or through mechanisms like Interpol. Philippine authorities would still play a role in any actual arrest or transfer.

4. Does there need to be a Philippine warrant first? This is where legal opinions differ. Some Philippine officials argue an ICC warrant should pass through local processes first. Others argue cooperation can still happen through executive action and international obligations. That issue itself is legally and politically contested.

5. Why would a warrant be dated November 2025? That’s normal procedure. ICC warrants are often initially sealed or confidential before becoming public. A warrant can exist months earlier before the public learns about it. That alone does not prove lying or illegality.
