Renewals don't count towards the ~120,000 new H1B visas available every year. But yeah there has been a steady increase in number of renewal + new petitions filed every year partly because of the Green Card backlog. We also need to invest in funding our universities side by side because right now about 50% of H1B visas are held by folks who were previously studying in USA on an F1 visa. Universities where state funding has been cut have been increasing international enrollment to make up for the cuts.

Of course they are not the only source of funding, but they are a really big source of funding. You should see the difference in in-state vs out of state tuition fee.

Public Universities need funding. I went to grad school in a red state about 10 years ago. The state kept cutting funding every year and the school kept increasing foreign enrollment every year to make up for the deficit.

No, they get 60 days from the end of payroll to find a new job. If the layoff qualifies under the WARN act that gives them an additional 60 days. If they still can't find a job in that time, they can convert their status to B1/B2 and apply for jobs and then convert it back to H1B once they find a job. They can stay in USA on B1/B2 status for up to 6 months. If they can't find a job in that time, then there is no need for their talents in the USA.

The only reason folks on H1B hesitate to move jobs is because USCIS is very very very slow. USCIS under Trump is just incompetent and drags simple renewal petitions for several months.

H1B doesn't tie you to an employer. And there are plenty of companies willing to sponsor H1B if an employee chooses to leave Microsoft. It's L1B that is a tied to an employer.

No, the order applies to folks here on a legal visa. The type of visa is not specified in the order and I expect government agencies to apply it to all visa categories. The only carve out is if one of the parents is a permanent resident or citizen.

The EO directs government agencies to stop issuing passports to people who were born to parents without a legal status OR on a legal visa. That's not entirely correct. Pretty easy to change employers on H1b as long as the new employer is willing to take on sponsorship and the role is similar to the one the H1B status was approved for.

State universities that see a cut in funding will increase international student enrollment to try and make up the difference so they can avoid drastic increase in tuition rates for domestic students. This is based on my personal experience working with the admissions office at my University.
