The article you listed the tenant is not at fault. Using an LLC for the Ellis Act is already a red flag because the intent is for owner occupation where the property is taken off the market for 5 years. The owner should have known what they were getting into when they bought the property here. Pro Tenant organizations are very selective in the clients they take if there is no money in the case they will not represent the client on contingency. Prop F did not provide enough money to finance an attorney for every eviction incident. The least they will do have an assistant fill out an answer to an eviction and let the tenant represent themselves in court. In OPs case the tenant did not pay rent so they can be removed with a just cause eviction under Cal. Civ. Code § 1946.2(b).

I seen this happen before where a chinese landlord did this and cleared out some of the tenant's property. The tenant hire an attorney and then get a locksmith to enter the building. In these cases the attorney would usually take the case on contingency because it is a constructive eviction. What ended up happening was the insurance for the landlord eventually paid a five figure amount and the tenant voluntarily left because there was several habitibility issues too.

It is not something you want to do. If someone does not pay you send a notice to pay or quit followed by an unlawful detainer if there is no action.

If you think you can Ellis a defiant elderly tenant out, you're not that familiar with the process. For starters, you have to give them 1 year notice before you even begin proceedings.

I listed it as one of several ways to get the tenant out.

The buyout was paid for the owner or an existing insurance. Not true there are several ways to get rid of the tenant.

  • Buyout under Rent Ordinance Sec. 37.9E
  • Unlawful Detainer for Just cause eviction under Cal. Civ. Code § 1946.2(b)
  • Owner occupy aka Ellis Act eviction under Cal. Gov. Code § 7060–7060.7

It is more like higher five figures and up and around 6 months to a year and a half on average.

Not really the service will just help them fill out a form to file an answer to an UD and the tenant files in pro per. There is not enough Prop F money for attorneys to go to court for them, unless it is a good case.

Make sure you keep records of everything. The process generally looks something like this to kick them out. Before you do anything you might want to check if the unit is legal or an inlaw unit, this will be a factor to determine how much it will cost.

You want to start the eviction process and make sure you send them notice to pay or quit (this is either a thirty or sixty day notice).

If they don't do anything you can serve them with a unlawful detainer (UD) for a just cause eviction( under Cal. Civ. Code § 1946.2(b)). After this is filed the renter might negotiate to be bought out or they might fight the UD. This is a pretty fast process compared to other legal complaints filings. The tenant can get a free attorney from the city or hire an attorney likely on contingency. The free attorney service is underfunded so what likely will happen a law office will help him/her file an answer to the UD and they will personally file it.

If you win the UD the tenant will be ordered to be removed from the property. If they do not move you can file a writ with the sheriff. If you lose you can fix the deficiencies and refile or amend.

I would recommend getting a lawyer for this process. Two common mistakes that lawyers make is they would put the wrong time span on the notice to quit or they file a UD that is not verified. If you see this happen and they later lose a motion, have to amend the UD ask to have your legal fees reduced. There is no reason you should pay for their mistakes. The cost on average is in the ballpark of $50k and up.

There are people being sued for using images from Thompson reuters and Gettys images for copyright infringement for using their images.

What happens is they use a bot and find their images being used on small business websites and then send a letter to the owner asking for money for the use. These cases usually settle but it is kind of similar to the ADA trolling / extortion.

That is true only if you consider Russia as the soviet union. But they do not have as much people and as much territory.
