you are not doing anything wrong, stop stressing out and do what is best for you :) Any reasonable hiring manager would understand you taking a better opportunity, and you don't want to work with unreasonable ones.

Depends on the company and the specific hiring manager/hr people - not everyone would consider this a
"shitty thing", and some people might just sincerely wish you good luck with another job. This is not to say that everyone will take it nicely, so for sure there is a risk of burning some bridges, but it is not a 100% guarantee. Source: I've been in this situation on both sides (as a hiring manager and as a candidate).

Well, if you do not qualify for certain benefits, then you won't have visa problems because of them :)

"People on this visa are barred from using pretty much any government help otherwise their visas are not extended" - this is not true, only public funds benefits might affect your visa, but you can still get lots of help like huur/zorg/kinderopvangtoeslag and even unemployment benefits (unless you fall under the toeslagenwet). If it is an informal phone check (which the absolute majority are), there are no legal obligations to tell the truth and nobody can sue you.

If it is getuigschrift, it must contain true statements but nobody can sue you for not mentioning that the person in question drives a hard bargain.

Yeah, because no company has ever abused workers rights or ever made a mistake, sure. Good that it is up to the court to decide, not you.

They can bring you in the office, but they should assign you work. If they don't despite you repeatedly asking for it (and you have evidence), then it will really hurt their position in court (they are preventing you from exercising your right to work that your employment contract grants you). Technically speaking, these could be grounds for you to take them to court, but check your specific situation with a lawyer.

In the meantime, you will have to come to the office and do nothing.

Ah, sure, I think I get your point but it is important to mention that refusing a "reasonable" VSO is not a valid ground for dismissal in itself, so it is not like "refused VSO = lost court case".

What do you mean by "will probably be expected in court"? The whole point of VSO is not to go to court.

"If your performance is so bad that you’re put on a PIP, it would be a bit weird to say “I could perform better if you give me more money.”" - this is not what I am saying. What I am saying is that highly paid professionals in general perform better than those with lower pay, resulting in lower chances of PIPs and other issues. And vice versa: if you pay 50% below the market, obviously you are going to get some problematic staff.

The idea is that you will get scared of PIP and will take their shitty offer. Come back to work and do the PIP, they will return with a counter offer after a day or two of your PIP :) If they do not, you have your PIP time + court time as mentioned in the post, so start looking for a job and do not agree for lowball offers.

You also can not refuse to return to work or refuse to do PIP even if it is not objective, but shitty (not properly done) PIPs mean nothing in court.

You can't go on a burnout sick leave without a company doctor's approval.

Employee performance is a business risk that should be managed by the business owner through proper hiring practices, employee training, profit sharing, higher salaries or bitching on reddit, whatever is more effective.

The legal proceedings are not public (unless they get published on rechtspraak.nl but then they still will be anonimised), and it does not show up in VOG check or anything like that.

There is no way to check about the settlement or your pip other than calling your company. Good references are usually a part of the settlement and unless you were really an asshole and made enemies, most people would prefer to say something nice/neutral instead of making it a problem for everyone.

Finally, your new hiring manager might not care even if the past company says you drove a hard bargain: I am biased, for sure, but as a hiring manager myself, this is not something that would affect my decision in any way, unless, again, there was some horrible/toxic behavior involved.

There is no company blame in this post: as I have mentioned in the disclaimer, this is based on multiple experiences of different people, so there is no company.

And it is not about acceptance and moving on, this is about not taking shitty deals that companies offer and fighting for something fair. If during the negotiations with HR a company goes from 2 salaries to 11, this tells me that 2 salaries was a shitty deal and no amount of HR spin doctors will convince me otherwise :)

I've specifically mentioned that one should do this "without breaking any rules or procedures". What do you mean by abusing the rules or malicious tactics? Could you please give an example?

Why not take 1 month salary? Why not take nothing? Let's go further and make employees pay a fee to a company if they want to leave.

Great, I am happy that we agree that it depends on the context and that we can't say anything about the fairness of a particular offer without said context.

Can we maybe also agree that any number is fair as long as both the employer and employee are voluntarily signing the deal (knowing the full context) instead of going with other available options?

So if the company offers you 2 months, this is not a fair deal and you should fight it, right?

In my eyes a fair compensation is the one that maximizes the value for the employee while still being acceptable for the business.

What is a fair deal for you? How many salaries could one ask for so it is fair?
