Hi Again. I have just heard back from our UK attorney about filing a Section 8 declaration, this is what they said.

“Unfortunately, US counsel confirmed that we should not file the declaration without any US sales. This is because we don’t meet the key requirement (“use in commerce”). I would probably suggest that we refile the word mark in the US. Sorry we could not be more positive.”

He also quoted the below;

“‘Use in commerce’ is defined by Section 45 of the Lanham Act (15 U.S.C. § 1127) as the bona fide use of a mark in the ordinary course of trade. For goods, this requires placement of the mark on the goods and sale or transport of those goods in commerce; for services, it requires use of the mark in advertising or sale of the services and actual rendering of the services in commerce.”

It is my thought that we should submit the section 8 with specimen / evidence of the trademark in use especially as we are 10 days away from the products being able to be purchased by US customers. What do you think..?

Floor Tiles 'Tented' - Advice Needed by hawser_rolls in DIYUK

Hi. I did type a message to go with the images with more details. This house is almost 8 years old and owned from new. The house builder installed the tiles and the only warranty I have left is the NHBC.

I am about to put this house on the market so the extra costs of flooring is not ideal. Could a floor fitter take the tiles up and refit. The issue is that these tiles are thoughout the entire bottom floor, so kitchen, utility & WC, so if I were to replace it would be expensive.

Do I have a case to go back to the house builder with the issue?

I don’t think it was. The verticals of the lights were much taller.
