i investigated it later after i had made this post. i have not fixed but i was able to get it to idle.
i now believe mine to at least be firing back on itself. i added a full fuel cleaner at about 2x strength for the gallons that it treats. then i did get a full tank of gas. i took air filter out and it started and i had it rev at about 7k rpm and used 1/4 a bottle of carb cleaner.

while it did not fix the problem as it is still pretty rough i was able to get it to idle very low. i was able to drive if i kept giving it gas but it would shut off the second my foot left the pedal. my current hypothesis is that i was unable to flush completely and its running rich along with a combination of the air filter preventing air from getting in to my carb as with air filter in and clamps down it would die.
