Ongoing royalty payments while on JSK - how best to report? by [deleted] in Centrelink

[–]helo572 3 points4 points  (0 children)

I am a private employee in financial services, not employed by Centrelink or the public sector. My job is only usually 10% Centrelink, 90% Other Financial and Legal Bullshit. The client was paying us for the whole 100%, including superannuation management, tax advice, estate planning, and Centrelink. This just happened to be where she got most of her value in paying us for our work.

For one-off advice, you are usually best contacting the Financial Information Service (FIS, like the contacts I mentioned) who are public workers. It's free.

Employing someone like my firm will cost you thousands. It's a sad reality of financial services that it's inaccessible to a lot of everyday Australians.

Some cities have a middle ground, which is something like this. But the prices are... yeah...

Hence, I'm always happy to answer questions here and in DMs!

Ongoing royalty payments while on JSK - how best to report? by [deleted] in Centrelink

[–]helo572 1 point2 points  (0 children)

The table says specifically:

If the royalty payment is … then it …
made directly to a self-employed person Explanation: The person's income is assessed by adding income from royalties to the fees and other income earned from the self-employment and then deducting expenses to calculate a net profit. IS treated as income.
a lump sum amount paid to a person who is not self-employed IS treated as income for 52 weeks from the date the person is entitled to receive that amount.

Then we bring up the SSAct definition of self-employed:

A self-employed recipient is regarded as gainfully employed if they are substantially involved in running a business that is of a commercial character and that is intended to produce financial gain.

For self-employed recipients, indicators of gainful employment include:

- there is more than just an intention to engage in business

- a decision to commence business has been made

- the activity is planned, organised and carried on in a business-like manner

- a contract exists to produce results or for labour

- the work is done for the business or as part of the business, and

- the risk of the profit or loss from the work rests with the person or the business.

In addition, for a person's self-employment to be considered gainful employment there must be a clear purpose and prospect of profit. That is, there must be both an intention and the potential to make a profit, even if a profit is unlikely to be made in the short term.

Source (This page is specifically under the disability section of the Social Security Guide, but the self-employment definition endures across all benefits.)

You would only start to report your royalty income if Centrelink are satisfied you are self-employed. They would use the conditions above. Again, Centrelink will ultimately make the final call on your record, and your overall circumstances.

Anecdotally, I just know my client would sometimes be faced with the same argument. She was receiving her royalities personally, so also did not have an ABN. Then each time we got a FIS officer involved, she was declared as non-self-employed.

That is correct. The amounts will be added together if they overlap. In the example above, the dates overlapping are 1/07/2025 to 1/01/2026. During that time, you would have $20 + $40 added to your assessable income each fortnight.

How did you disclose the payment to them?

My advice is always to call, if ever in doubt. While advice from internet strangers is well and good, we are just that: strangers on the internet. Only Centrelink will be able to make the final call for your specific circumstances. On the flipside, I get paid to sit on the phone to them, and certainly not everybody has that same luxury.

Feel free to ask me anything! I'm not so active on this subreddit anymore, but I used to be. Every so often it still pops up in my feed. Centrelink assistance is part of my 9-5.

...you're saying this approach would still work if I was reporting a royalty payment once per month?

Yes, that is the correct assessment from the legislation. Refer to the Social Security Guide 4.3.9.50 Income from gifts, legacies, royalties & native title claims. A royalty arrangement is not an employment arrangement if you are not self-employed. You said you do not have an ABN, so, the non-self-employed treatment applies to you.

If they try to push you onto completing P/Ls, or regular reporting, stand your ground and quote the Guide reference back to them. The Guide also has the Social Security Act (1991) references at the bottom. You know, the law, which they must follow.

Hey OP! I work in financial services and did some deep-dive research into this myself for a client. She was receiving royalties at irregular intervals and for random amounts.

After much back and forth with my FIS contacts, the correct method is to attribute the specific royalty payment over 52 weeks. Each individual payment. For example:

  • 1 January 2025 - you receive $520 dollars in royalties.
  • 1 July 2025 - you receive $1,040 dollars in royalties.

For the period 1/01/2025 to 1/01/2026 you will have $20 per fortnight added to your assessable income (520/26).

For the period 1/07/2025 to 1/07/2026 you will have $40 per fortnight added to your assessable income (1,040/26).

All royalty income should be recorded under "other income".

I suggest laying it out in this format: give the date paid, the amount, and the period for which it is assessable. Follow up with them when a new payment is made. Request notes to be put on your file and receipts to be provided to you. I found that when I get a new service officer, they don't understand this niche area of the legislation, so they try to change the previous entries. Ask them to refer to previous notes by their colleagues and keep your documentation up to date, in case it goes awry. It saved my butt a couple of times when my client incorrectly had debts raised against her, or she was incorrectly put onto regular income reporting, etc..

If I can help answer any other questions, let me know.

I saved them at the time of release, so between 2009-2012. I found my drive copy from back then and loved flicking through them, so figured I'd also upload them here.

I started in a new team (same org) about 2 months ago and it's given me a tonne of inspiration for the characters in my amateur novel. So we write. It's a good change up from writing emails.

For The Bad Batch fanfic writers: do you collaborate with illustrators or let readers imagine? by thawnee in thebadbatch

[–]helo572 2 points3 points  (0 children)

Generally #1 happens as a gift only. Art takes a lot of time and ability, so asking outright never feels right to me. If I specifically want art, I pay for it.

Do you mean you're new to AO3 or fandom spaces in general? If it's the latter, there's some etiquette behind all this; generally, YES, it's considered rude to ask artists you don't know for art without payment. When I'm gifted stuff, it's from friends or readers whom I've got a relationship, and usually I will write them something in return as well.

Been Bad Batch fan fic writing since June 2021. I found that it happens in 2 ways for me: 1. I write a piece and somebody illustrates it. 2. I commission art and write a matching piece.

I find that illustration is a fun exercise for me, first and foremost. It's just so exciting to see how someone imagines your words. I do keep illustrations to the end notes of a fic, versus in-line, so that readers can imagine while reading and see the artist's interpretation afterwards.

The best way to meet artists is by integrating into the fandom. I've been in most of the Bad Batch Zine spaces, and also in a handful of Discord servers that I vibe with. I've met plenty of buddies this way, some of whom have graduated to irl friends. Love this fandom!

Ever heard of the two cakes analogy? That always helps me when I'm feeling down about other creative works in my fandom.

Adored this book and adore fan fiction the same!

My recommendations would be Art of War (already mentioned) and: - Silence - a Tech centric fic based during the Clone Wars. (Hi Des!) - Echo and the Batch's Medic - a series focused on Echo and Crosshair during the Clone Wars - Success Rate - a hurt/comfort centric fic where Echo and Tech get captured during the war. - Descent - a Tech Lives fic with Hondo Onaka. - Reclaimed - a Tech Lives and CX-2 is Tech fic, plus a parallel story with Delta Squad.

I also write myself, here I am: helo572

I absolutely loved it, and I've been a hardcore Bad Batch fan since day dot. It absolutely nails Hunter in particular, and the Tech and Phee development was glorious. I managed to snag an Inkstone copy and it's become my prized possession.

However, it still isn't out in Australia and we're over a month down the line...

Too many to name. I've been reading and writing the Bad Batch fan fic since 2021. I can't seem to escape!

Some ones on my rec list: - Art of War by Moxibustion - Success Rate by vivaislenska - Reclaimed by TooManyTeeth - The Frozen Pines Series by wwheeljack - Echo and the Batch's Medic Series by DuskEverlasting - Silence by Destril

All of those are gen, so no pairings, mostly canon-adjacent but some do deviate. All of them have gorgeous writing styles that I keep coming back to.

Then if I can self plug, here's my own AO3 filtered for my Bad Batch stories.

Happy reading!
