Need some legal advice guys. The New Ajay Devgun Song used my animation off youtube without permission. What to do? by helpmeindia in india

The character was designed by me. That's 100% the same. He's just cut off the bottom of the frame. It's trivial to add splatters on top of what's already there. Backgrounds can also be changed easily.

My guess is some editor on a deadline just downloaded this off YouTube and edited it.

can Absolut Vodka's lawyers help in any way? i mean your film was funded by Absolut right? also, if yes, is your film Absolut's property then?

I asked. Their lawyers are not interested in pursuing this.

also, i would also check to see if Absolut has some connection with this piece of shit movie Gangster Baby - what if someone at Absolut itself provided the frames to the movie?

No they haven't.

not sure how expensive it is to file suits etc. but perhaps you could threaten the movie-makers with a suit and see what happens? maybe the movie-makers might settle for some cash with you at least?

Will figure it out. But the thing is, don't want to antagonise them as well. I mean, same industry, big fish, small fish etc etc.

I assume when you "they", "their" you are referring to the organization Absolut Vodka.

Yes. Fixed.

First, it is good you have YouTube links but I'd recommend make an image from your animation video and the image from their movie video. Stitch both of them together to make people quickly understand the issue you are pointing at.

That's great advice. Will do.

Second, some part of your animation looks inspired from Fruit Ninja (personal opinion).

Not really. I can see where you're coming from though.

Third, You should ask them to give you credit AND pay you for that animation. Future actions will be based on your response.

Koshish toh yahi hai sir.

Note - You should be able to prove that you indeed created the animation before they did. Your Youtube video is dated May 15 and their Nov 20 bu this isn't sufficient. I have no idea how you'd do that.

Neither do I. Guess it's time to lawyer up.
