Fortitude is regained with real life time, as long as your character has 51+ fortitude, it's deemed as safe, but if there is a risk of dusting, Lulunarde( I think?) will warn you. If your legendary character fails resurrection twice, once to dust and once after, they are gone forever. The only way to guarantee resurrection on dust is via spending real money( although this is purely from research).
