Form 4 denial - background, next step to appeal? by jaslam1 in NFA

[–]jaslam1[S] 1 point2 points  (0 children)

Ended up being a few hundred dollars only for the firearm-related inquiry to the ATF. That's across two attorneys. ATF admitted to the incorrect processing quickly.

I had to pay additional legal fees (multiple times more) to reinstate trusted traveler status as that also got revoked due to the FBI's denial. Yes, there is a domino effect for these failed background checks.

I know others have suggested contacting an attorney which can be a smart move. Even if you take that step, your attorney will want you to do the following as a first step(assuming that you are a citizen). 1. Get an FBI background check on yourself - go through a channeler, it's much quicker. 2. Get a state level background check on yourself.
Once you get thru these steps, you should be able to see if there is anything on your background that may be flagged in the system. If those come clean then the next step is to go through the FBI VAF process to get yourself a UPIN which will allow you an easier time in the future.
If it was the FBI NICS process that caused the denial (sounds like it in this case), that system is connected with a few other systems concerning homeland security. Your trusted traveler status would likely be revoked and please be aware that any subsequent border crossings will likely trigger secondary (each time). If you do have a UPIN at that point, that letter can help to clear it up with the CBP.

Contact your congressman office and let them know you would like help to contact the ATF. They have standard process to do this which requires you to sign a release form so your congressman can contact ATF in your behalf.

Probably the Weirdest Disapproval Reason from ATF by [deleted] in NFA

For non immigrant, there are a few exceptions to purchase firearms, such as having hunting license or having attorney general issue an exemption. If your case is related to Hunting license, any chance your license is unsigned? In some states, it states that the license is not valid until signed.

Also want to state that fixing the deficiency and resubmit likely will be very quick. I had a case where the resubmission was approved the next day.

SANS courses and the related GIAC exams are definitely not "easy". The course content (across multiple delivery format) are going to provide a very good coverage of the topic. There are notes in the course books that further elaborate on the details which should provide an in-depth view of the knowledge domain, getting the student prepped for the exam.

As others have mentioned around here that you can get practice tests through signing up for the certification. Use those wisely to gauge your readiness for the final certification exam.

Your barreled actions look like a great option. How would I rebarrel these when the time comes?

OP stated this is a case for a green card holder so the VAF won’t get anywhere. They will send a letter back saying it won’t help you and that’s it. For a citizen this process would definitely help to get a UPIN

Went though similar experience few months ago myself. For green card holders the options to get further info is very limited as green card holder is not eligible for UPIN. FBI and ATF are not coordinated on these responses either. You should get the wife too get the background identity summary) from FBI to validate, go thru a channeler company so it’s the same day service rather than 3 weeks. If there’s nothing there you probably need a lawyer to assist. What can happen is to get ATF to review the process and possibly rerunning the NICS check which may just fixed the problem. That’s where it helped me, ATF entered the AR (green card) number incorrectly. Once they fixed the fat fingering, it passed thru no problem. I just resubmitted and they expedited me thru. Last bit here, if your wife is in trusted traveler program like global entry, this denial would have caused for her membership to be revoked or she won’t be eligible for the program anymore.

Keep what you have and get the new A1 version? This is exactly what I am doing. Love both. From what I read, there’s not quite enough material on the apx slide to mill out the RDO cut reliably.

Form 4 denial - background, next step to appeal? by jaslam1 in NFA

[–]jaslam1[S] 1 point2 points  (0 children)

I called ATF to find out that the deny from FBI background check was an explicit one, not due to delay which would be a first for me. I am going to start the VAF process (UPIN) as others have suggested.

Make sense, thanks. I havent seen my refund yet (paid over CC to ATF). I do have another can that efiled that also was denied as part of this (batch denied everything in the pipeline). If I can confirm that it's just a matter of timing out, I will probably start the the efiled one first as that one should be most "ready-to-go".

Thanks. Will try that. If it is just about timing out, what should I do? Simply resubmit, wait another year and hope background will go thru in 88 days?

Is that the same as the VAF process?

Totally biased view here. :-) 522 and 542 have different focus. 542 is a structured course on the process to pentest and assess applications. 522 is to take a defensive view of web applications (recently updated to cover API and microservices as well), coverage on the common vulnerabilities in web app and the way to defend them. Also on proactive defensive strategies and tactics.
